And that, my friends, is exactly where Cheryl Baker finds herself — not in jail, not fleeing the country, just quietly living in Vinita, Oklahoma, while a corporation in Iowa files a lawsuit over a car that’s long gone, sold at auction, and still somehow not quite paid off.

So who is Cheryl Baker? On paper, she’s a single woman in her 50s, working as a manager at Broken Arrow Pet Resort, pulling in about $3,457 a month — not exactly Wall Street money, but enough to keep the lights on and maybe spoil a few dogs. In June 2019, she walked into Overdrive Automotive Center, a buy-here-pay-here dealership in Tulsa, and walked out with a 2013 Chevy Equinox. The total price tag? A cool $21,375.36 — which included $5,991.36 in finance charges, because apparently driving a nine-year-old crossover in 2019 came with a built-in interest surcharge. She put down $500 and started making monthly payments of $474.44, which sounds like a lot for a 10-year-old SUV, but hey — credit scores aren’t always kind.

Now, Globe Acceptance, Inc., the plaintiff in this case, isn’t the dealership. They’re the money people — the kind of company that buys up auto loans from sketchy buy-here-pay-here lots and then sues people when they fall behind. Cold? Maybe. Effective? Absolutely. They’re based in West Des Moines, Iowa, but their reach extends deep into Oklahoma’s backroads, and they don’t mess around. Their attorney, Nathan V. Swoyer of Osborn Jacobs & Hartung PLC, sends letters that read like a mix between a legal threat and a customer service survey — complete with QR codes and a toll-free number. This is modern debt collection: slick, automated, and emotionally detached.

Here’s how it went sideways. Cheryl made payments — not always on time, not always full — but she paid. The ledger shows a trail of partial payments, late fees, and confusion. In August 2019, she paid $232.50. In October, $234.44. By November, she was $474.44 short, and then paid only $214.02. The pattern repeats: missed payments, late fees of $22.50, “convenience fees” of $5 (because charging you $5 to pay your bill is apparently still a thing), and a growing balance of past-due amounts. The interest rate? A cheerful 18.99% — because when you’re lending to people with spotty credit, you either charge a fortune or you don’t sleep at night.

By early 2023, the situation had snowballed. On February 15, 2023, Globe Acceptance sent Cheryl a letter titled “Notice of Plan to Sell Property.” Translation: We took your car. You didn’t pay. Now we’re auctioning it off. The Equinox was repossessed, and Cheryl was told she could redeem it by paying $5,721.37 — in wire transfer only, no cash, no checks, no IOUs. That’s the kind of number that makes you laugh or cry, depending on your emotional bandwidth.

She didn’t redeem it. So they sold it — at auction, for $2,600. That’s $2,600 for a car that, just a few years prior, was being financed like it was some kind of luxury asset. But here’s where it gets wild: after the sale, Globe Acceptance says she still owes money. How? Because they tack on repossession costs — towing, storage, paperwork — plus late fees, interest, and a $390 “collection fee.” After all that, the math says she still owes $4,053.54. Then, because time is money and lawsuits generate interest, by May 2023, that number had grown to $4,306.61 — the amount Globe is now suing for in Mayes County District Court.

So why are we in court? Because Globe Acceptance claims Cheryl broke the contract. Simple as that. The legal term is “breach of contract,” which, in human language, means: You promised to pay, you didn’t, and now we want a judge to make you pay anyway. They’ve already repossessed and sold the car — a move meant to cut their losses — but since the auction didn’t cover the full balance (plus all their fees), they’re allowed under Oklahoma law to come after her for the difference. This is called a “deficiency judgment,” and it’s how finance companies make sure you don’t just walk away from a bad loan with nothing but a lighter wallet and a story.

And what do they want? $4,306.61. Plus interest at 18.99% per year from May 31, 2023, onward. Is that a lot? For a used car that sold for $2,600? Absolutely. For a company that already collected over $18,000 in payments and fees before the repo? Maybe not. But for Cheryl Baker, a pet resort manager making $3,457 a month, $4,300 is more than a mortgage payment — it’s a month and a half of rent, or a year of vet bills for every dog she’s ever spoiled at work. It’s not bankruptcy-level money, but it’s not nothing. And let’s be honest — if she had $4,300 lying around, she probably would’ve just paid the damn thing and avoided this whole drama.

Our take? This case is a perfect little time capsule of how the American subprime auto loan system grinds people down. A woman buys a car to get to work. She pays what she can. The company charges her fees for being late, interest for being alive, and then takes the car and sells it for less than it’s worth — only to turn around and say, “Hey, you still owe us, actually.” And now, instead of just losing her car, she might lose her credit, her peace, and possibly a chunk of her paycheck — all over a 2013 Equinox that probably didn’t even have working AC.

The most absurd part? The $5 “convenience fees.” Not the repossession. Not the 18.99% interest. But the fact that every time Cheryl tried to make a payment — often late, often partial — they slapped on a $5 fee for the inconvenience of accepting her money. The irony is so thick you could slice it. We’re not rooting for anyone to win — but if justice had a sense of humor, Cheryl would show up to court with a $5 bill taped to a handwritten note that says, “Here’s your convenience fee. Now go bother someone else.”

Swoyer, and in support of its cause of action against the Defendant(s) states to the Court as follows: 1. The Plaintiff is authorized to do business in the State of Oklahoma. 2. The Defendant(s) are individuals of Mayes County, Oklahoma. 3. On or about June 8, 2019, the Defendant(s) entered into a written contract for the purchase of a motor vehicle. A true and correct copy of said contract is attached hereto. 4. The Plaintiff is the current owner and holder of said contract entitling Plaintiff to all of the creditor's rights, title and interest in said contract and the vehicle described therein. 5. The contract required the Defendant(s) to make monthly installments during the term of the contract. 6. The Defendant(s) failed to pay the Plaintiff the monthly installments due under the contract, and such failure constituted a default. 7. By reason of said default, Plaintiff exercised its rights of acceleration under the contract, and declared the unpaid remaining payments due and owing. 8. Subsequent to the default, the Plaintiff repossessed said motor vehicle, and pursuant to applicable law, disposed of it in a commercially reasonable manner. 9.
