Tinker Federal Credit Union v. Roger P. Dutil, Jr.

Filed: Mar 23, 2026
Type: CS

What's This Case About?

Let’s be honest: nobody tunes into CrazyCivilCourt expecting high drama. We’re not here for murder plots or celebrity scandals. We’re here for the quiet, devastating tragedy of a man named Roger P. Dutil Jr. who, somewhere between December 2023 and March 2026, went from “pre-approved loan recipient” to “defendant in a two-loan breach of contract case” — and now owes a grand total of $155.99… on a $4,000 loan. Yes, you read that right. He’s being sued for under $160 — but don’t let the small number fool you. This case is a masterclass in how credit unions turn “slightly behind on payments” into full-blown legal theater.

So who are these people? On one side, we have Tinker Federal Credit Union, a financial institution based at Tinker Air Force Base in Oklahoma, which sounds like it should be run by stern but fair airmen in crisp uniforms, not lawyers drafting breach-of-contract claims over pocket change. And yet, here we are. They’re represented by Jeffery S. Ludlam of Hall & Ludlam, PLLC — a firm that, judging by the docket, spends a lot of time collecting small debts for credit unions. On the other side is Roger P. Dutil, Jr., a civilian resident of Lawton, Oklahoma, who — based on the credit union’s own glowing language — once had “excellent credit history” and was deemed worthy of two pre-approved loans in back-to-back years. He was, at one point, the golden child of TFCU’s lending department. And then… something happened. Maybe life got expensive. Maybe the holidays hit hard. Maybe the home improvements didn’t pay off. Whatever it was, Roger stopped making payments — and now, the hammer has come down.

Here’s how it all went down. In December 2023, TFCU slid into Roger’s mailbox with a literal check for $4,000 — no strings attached, just a friendly “Hey, you’re doing great, here’s some money!” kind of vibe. The letter called it a “pre-approved loan” at a “low fixed 12.95% APR.” Sounds reasonable, right? Except when you look at the Truth in Lending Disclosure (because of course there’s a Truth in Lending Disclosure), that $4,000 loan was going to cost Roger $1,147.44 in interest over 48 months. That’s not “low.” That’s “I’m-glad-we’re-not-in-a-predatory-lending-state” levels of interest. But Roger signed it, endorsed the check, and presumably bought something nice — maybe a new HVAC system, maybe a boat, maybe just paid off some other debt. We don’t know. What we do know is that as of March 18, 2026, he still owed $155.99 on that loan. Not the full balance. Not even close. Just a little over a hundred and fifty bucks — the cost of a decent dinner for two and a bottle of wine.

But wait — there’s more. Because in December 2024, TFCU did it again. Same deal. Same cheerful letter. “Could you use a little extra cash?” Oh, Roger, you just got one loan — but sure, why not take another? This time it was $5,000 at 11.95% APR, payable over 60 months, with a total interest cost of $1,665.94. Again, not exactly charity. But Roger took it. Maybe he was consolidating debt. Maybe the first loan wasn’t enough. Maybe he just really liked getting free checks in the mail. Whatever the reason, by March 2026, he had fallen behind on this one too — to the tune of $4,437.30. That’s not chump change. That’s a car payment. That’s a vacation. That’s a down payment on a used truck.

So why are they in court? Because TFCU is suing Roger for breach of contract — twice. Once for each loan. They’re not accusing him of fraud or identity theft or anything flashy. They’re saying, quite plainly: “You signed a contract. You got the money. You promised to pay. You didn’t. Now we want what’s ours.” And legally, they’re on solid ground. The promissory notes are attached. The disclosures are there. Roger signed them. There’s even an affidavit confirming he’s not in the military — a required step under the Servicemembers Civil Relief Act, which protects active-duty personnel from aggressive debt collection. TFCU checked the box. They did their homework. They even asked the court to order the Oklahoma Employment Security Commission to hand over Roger’s employment info — a move that feels a little Big Brother, but hey, when you’re chasing $4,593.29, you take what you can get.

Now, what do they want? TFCU is asking for $155.99 on the first loan and $4,437.30 on the second — totaling $4,593.29, plus interest, court costs, and attorney’s fees (which could be up to 15% of the amount in default, according to the contract). Is that a lot? For a $9,000 total loan? Honestly, not really. But here’s the kicker: they’re suing over $155.99 — less than the cost of a Peloton seat cover — on a loan that’s nearly paid off. That’s the kind of debt that could’ve been resolved with a phone call, a reminder email, maybe a sternly worded letter. Instead, they filed a lawsuit. They hired a lawyer. They paid a filing fee. They triggered a court process that costs everyone time and money. And for what? To collect a fraction of a fraction of what was originally borrowed?

And then there’s Exhibit C — a Limited Power of Attorney dated December 11, 2025, in which Roger allegedly appoints a company called New Start Legal (and its affiliates, including JG Wentworth — yes, that JG Wentworth) to negotiate settlements on his behalf. This document, while not directly part of the lawsuit, raises eyebrows. Was Roger trying to restructure his debt? Was he already in over his head? Was he being advised by a company known for buying out structured settlements — not exactly a sign of financial stability? The timing suggests he was already struggling — and yet, TFCU waited until March 2026 to sue. You have to wonder: did they see this coming? Did they send the second loan knowing he was behind on the first? The pre-approved offer doesn’t exactly scream “credit risk assessment.”

Our take? The most absurd part of this case isn’t the amount. It’s the escalation. This isn’t a story of fraud or malice. It’s a story of a guy who took out two loans, fell behind, and now faces a full-blown legal action over a debt that, on the first loan, is practically rounding error. TFCU could’ve worked with him. They could’ve offered a payment plan. They could’ve waited. Instead, they chose to sue — not just for the big balance, but for the tiny one too. It’s overkill. It’s petty. It’s the financial equivalent of calling the cops because your roommate didn’t pay their share of the Netflix bill.

Are we rooting for Roger? Not because he’s innocent — he clearly broke the contract. But because this feels like a system that punishes small missteps with disproportionate force. A credit union with deep pockets and legal counsel is chasing a man for $156 — and we’re supposed to believe this is justice? Please. This isn’t justice. This is bureaucracy with a grudge.

We’re entertainers, not lawyers. But even we know this: sometimes, the real crime isn’t the breach of contract. It’s the lack of common sense.

This status includes information on a Servicemember or his/her unit receiving notification of future orders to report for Active Duty. The Defense Manpower Data Center (DMDC) is an organization of the Department of Defense (DoD) that maintains the Defense Enrollment and Eligibility Reporting System (DEERS) database which is the official source of data on eligibility for military medical care and other eligibility systems. The DoD strongly supports the enforcement of the Servicemembers Civil Relief Act (50 USC App. § 3901 et seq, as amended) (SCRA) (formerly known as the Soldiers' and Sailors' Civil Relief Act of 1940). DMDC has issued hundreds of thousands of "does not possess any information indicating that the individual is currently on active duty" responses, and has experienced only a small error rate. In the event the individual referenced above, or any family member, friend, or representative asserts in any manner that the individual was on active duty for the active duty status date, or is otherwise entitled to the protections of the SCRA, you are strongly encouraged to obtain further verification of the person's status by contacting that person's Service. Service contact information can be found on the SCRA website's FAQ page (Q35) via this URL: https://scra.mdmc.osd.mil/scra/#faqs. If you have evidence the person was on active duty for the active duty status date and you fail to obtain this additional Service verification, punitive provisions of the SCRA may be invoked against you. See 50 USC App. § 3921(c). This response reflects the following information: (1) The individual's Active Duty status on the Active Duty Status Date (2) Whether the individual left Active Duty status within 367 days preceding the Active Duty Status Date (3) Whether the individual or his/her unit received early notification to report for active duty on the Active Duty Status Date. More information on "Active Duty Status" Active duty status as reported in this certificate is defined in accordance with 10 USC § 101(d)(1). Prior to 2010 only some of the active duty periods less than 30 consecutive days in length were available. In the case of a member of the National Guard, this includes service under a call to active service authorized by the President or the Secretary of Defense under 32 USC § 502(f) for purposes of responding to a national emergency declared by the President and supported by Federal funds. All Active Guard Reserve (AGR) members must be assigned against an authorized mobilization position in the unit they support. This includes Navy Training and Administration of the Reserves (TARs), Marine Corps Active Reserve (ARs) and Coast Guard Reserve Program Administrator (RPAs). Active Duty status also applies to a Uniformed Service member who is an active duty commissioned officer of the U.S. Public Health Service or the National Oceanic and Atmospheric Administration (NOAA Commissioned Corps). Coverage Under the SCRA is Broader in Some Cases Coverage under the SCRA is broader in some cases and includes some categories of persons on active duty for purposes of the SCRA who would not be reported as on Active Duty under this certificate. SCRA protections are for Title 10 and Title 14 active duty records for all the Uniformed Services periods. Title 32 periods of Active Duty are not covered by SCRA, as defined in accordance with 10 USC § 101(d)(1). Many times orders are amended to extend the period of active duty, which would extend SCRA protections. Persons seeking to rely on this website certification should check to make sure the orders on which SCRA protections are based have not been amended to extend the inclusive dates of service. Furthermore, some protections of the SCRA may extend to persons who have received orders to report for active duty or to be inducted, but who have not actually begun active duty or actually reported for induction. The Last Date on Active Duty entry is important because a number of protections of the SCRA extend beyond the last dates of active duty. Subject to applicable laws and TFCU rights, no late charge will be assessed on any payment when the delinquency is caused solely by a late fee assessed on earlier payments, and the payment received would otherwise be a full payment under the terms of this Loan. Security: Unless you are a covered borrower under the Military Lending Act or as prohibited by applicable law, you are giving us an additional security interest in collateral that may be securing other loans with us Contract Terms: You should refer to the Loan Agreement and Disclosure Statement and other contract documents for additional information about nonpayment, default, required repayment before the scheduled date, and prepayment limitations, refunds, and penalties. e = estimate Payments: You promise to make payments of the amount and at the time shown in the Truth in Lending Disclosures above until what you owe has been repaid. If you prepay part of what you owe, subsequent payments will remain due as scheduled. Your last payment will be the remaining principal balance plus accrued interest. You promise to make payments to us at the address we choose. You are allowed to prepay your loan balance and make monthly payments early without penalty, however, the “due date” for your next payment will not advance more than ninety (90) days. You are expected to make and continue to make and/or schedule a payment each month to meet the requirements of your loan agreement with us and to avoid default until your loan is paid in full. If this loan refinances another loan we have with you, the other loan will be canceled and refinanced as of the date of this loan. Unless otherwise required by law, payments will be applied to amounts owed in the manner we choose. Interest: You agree to pay interest on the daily balance of the Loan, beginning on the day we receive the endorsed Check and until your Loan is repaid in full, including after default and acceleration. The interest will be computed on the basis of a 365-day year and the actual number of days elapsed. Payments will be applied to: other charges, interest and then principal. Nature of Your Responsibilities: We can enforce this Agreement against you or any of your heirs, executors, or legal representatives. You may not assign or transfer this agreement to anyone. We may assign or transfer this Agreement and the rights or obligations under this Agreement to anyone without your consent, although we will send you notice of an assignment or transfer, if we do. All checks must bear the original signature/endorsement of the person whose name appears on this offer, which is subject to verification by us. Returned Check Charge: If a check or other instrument you use to make a payment on this Agreement is returned to you unpaid for any reason, you agree to pay us a returned loan payment fee of $20.00 Security Agreement: Subject to you being a covered borrower under the Military Lending Act or as otherwise prohibited by applicable laws, you hereby grant us all rights to secure this Loan by a security interest to the extent created by this Loan and this Loan is cross-collateralized by personal property, which secures any debt you have with us now or later, other than household goods. We may use any collateral secured by other loans you have with us, subject to you being a covered borrower under the Military Lending Act or as otherwise prohibited by applicable laws and your right of rescission. The security interest secures the Loan and any extensions, renewals, or refinancing of the Loan. Default and Remedies: You will be in default if: (i) you fail to pay or keep any promise on this Loan, this Agreement, or any other loan or agreement you have with us, (ii) you die, file for bankruptcy, or become insolvent, (iii) you make any false or misleading statements in any statement of credit information, (iv) something happens which we believe may substantially reduce your ability to repay what you owe. If you default, we can require immediate payment of the entire unpaid principal balance of the Loan, without giving you advance notice (called “Accelerate”). If we Accelerate the Loan payment, you will continue to pay interest at the same interest rate until what you owe has been repaid in full For a default under this Agreement, TFCU reserves all rights under the terms of this Agreement, other agreements with you for debts owed to TFCU, and under applicable laws. You acknowledge that we rely on the statutory right of offset, except as to excluded accounts. We can also exercise any other rights under applicable laws and statutes when you are in default. If you default on the Loan or this Agreement, you will be liable and will be required to pay all reasonable costs, expenses, and fees we may incur in connection with collecting any money you owe us for the Loan, including attorneys’ fees up to fifteen percent of the amount in default or as provided by applicable state statute and applicable laws. Waivers: We can delay enforcing any of our rights any number of times without losing our rights. You hereby waive demand, presentation, protest, notice of dishonor, and notice of protest.
