Tinker Federal Credit Union v. Rachel S. Hauck

Filed: Mar 16, 2026
Type: CS

What's This Case About?

Let’s cut right to the chase: a credit union in Oklahoma is suing a woman for $3,715 in overdraft fees — not because she stole a car or scammed anyone, but because her bank account went negative and she didn’t magically fix it. And get this — the credit union already took the money out of her account, then charged her for the privilege of being overdrawn, and now they’re suing her to get those fees back. Yes, you read that right. This isn’t a heist. It’s not even a Ponzi scheme. It’s just one woman, two bank accounts, and a financial black hole that swallowed over three grand in penalties while she allegedly watched from the sidelines like, “Huh. That’s unfortunate.”

Meet Rachel S. Hauck, a resident of Edmond, Oklahoma, who — according to her own account application — is unemployed, though at one point listed herself as self-employed and a server. She opened two accounts with Tinker Federal Credit Union (TFCU), a financial institution that, by name alone, sounds like it was founded by a group of Air Force mechanics who just really liked compound interest. The first account, Share 0001, was opened in March 2018. The second, Share 0004 — dubbed “Everyday Spending” — came along in July 2024. Sounds innocent enough. “Everyday Spending” is probably where she paid for gas, groceries, and the occasional DoorDash when she was too tired to cook. Or maybe too broke. Or both.

Now, let’s talk about what actually happened, because the timeline is… chaotic. On November 24, 2025 — yes, the filing says 2025, even though it was filed in 2026, which is either a typo or we’ve entered a financial time warp — Rachel’s primary account, Share 0001, had a balance of $367.17. Over the next few days, she made a series of internal transfers between her two accounts, moving money around like a one-woman hedge fund. She sent $54 to the other account. Then $150. Then $443. Then $1,350. Then three separate $1,500 transfers — totaling $4,500 — from Share 0004 to Share 0001. Then back again. Then more. It’s like watching someone juggle flaming knives while riding a unicycle on a tightrope over a pit of late fees.

By November 30, Share 0001 had ballooned to over $21,000 — all of it seemingly transferred from the “Everyday Spending” account. Then, just as mysteriously, it was gone. Poof. Vanished. The account went from $21,461 to -$269.24 in one fell swoop, marked simply as “Withdrawal” and “Charge Off Process Completed.” No explanation. No ATM receipt for $21,000 in cash. No wire transfer. Just… gone. And the credit union’s response? Not “Huh, that’s odd,” but “You owe us $269.24.”

Meanwhile, the “Everyday Spending” account — the one that apparently funded the mystery $21k — wasn’t doing much better. On December 2, 2025, it shows a withdrawal of $3,715.02, followed immediately by another withdrawal of the same amount, which brought the balance to -$3,715.02. That’s not a typo. The account was debited twice for the same sum, like a glitch in the Matrix where the bank said, “Let’s charge her for being overdrawn, and then charge her again for having charged her.” The description? “Returned Check.” So either someone tried to cash a check that bounced, or TFCU is using “Returned Check” as code for “We took the money and now we’re mad it’s not there anymore.”

And just to add flavor: in the days leading up to this financial implosion, Rachel was living her best (or worst) life. There were multiple transactions at Starbucks. A $100 charge at Chick-fil-A. A $61 DoorDash order. Multiple deposits into Cash App and Apple Cash — possibly sending money to someone named “Ray Hauck,” which could be a relative, a typo, or an alternate identity she’s cultivating for her post-bankruptcy life. There’s even a $19.50 charge labeled “MoneyPlus,” which sounds like a payday loan store or a vitamin subscription, but honestly, at this point, who knows?

So why are we in court? Because TFCU says Rachel breached her contract — twice. Once for the primary share account ($269.24), and once for the Everyday Spending account ($3,715.02). In plain English: she didn’t keep enough money in her accounts to cover the fees they charged when she didn’t keep enough money in her accounts. It’s a financial ouroboros — the snake eating its own tail, but with more overdraft charges.

TFCU wants judgment for $3,715.02, plus attorney’s fees, costs, and “all contractual charges” — which could mean more fees on top of the fees. They also filed a request to have the Oklahoma Employment Security Commission hand over Rachel’s employment info, which suggests they’re not just after the money, but want to find the money — maybe to garnish wages, if she ever gets a job. They even included an affidavit confirming she’s not in the military, just in case she was planning to deploy to Afghanistan to avoid her bank drama.

Now, is $3,715 a lot? For a credit union, maybe not. For the average person in Oklahoma, absolutely. That’s a car down payment. A year of rent in a studio apartment. Three months of groceries. But here’s the kicker: this isn’t for stolen funds. It’s not for fraud. It’s not even for reckless spending — unless you consider moving money between your own accounts a criminal act. The core issue is that TFCU charged overdraft fees, took the money, and then sued when the account couldn’t magically replenish itself. It’s like a landlord charging you for breaking the lease, then suing you for not paying rent after you’ve already been evicted.

Our take? The most absurd part isn’t the amount. It’s the cycle. Banks create systems that trap people in debt, charge them for falling into the trap, and then sue them when they can’t climb out. Rachel Hauck may not be blameless — maybe she overestimated her balance, ignored alerts, or played the float game one too many times. But TFCU isn’t exactly the victim here. They processed the transactions. They approved the transfers. They charged the fees. And now they want a judge to make her pay for their own business model.

We’re not rooting for financial irresponsibility. But we’re also not rooting for a system that profits from people’s mistakes and then punishes them for being poor. If this case teaches us anything, it’s that “Everyday Spending” should come with a warning label: May include unexpected charges of $3,715 for the crime of running out of money. And honestly? That’s not a breach of contract. That’s just modern banking.

If you have evidence the person was on active duty for the active duty status date and you fail to obtain this additional Service verification, punitive provisions of the SCRA may be invoked against you. See 50 USC App. § 3921(c). This response reflects the following information: (1) The individual’s Active Duty status on the Active Duty Status Date (2) Whether the individual left Active Duty status within 367 days preceding the Active Duty Status Date (3) Whether the individual or his/her unit received early notification to report for active duty on the Active Duty Status Date. More information on "Active Duty Status" Active duty status as reported in this certificate is defined in accordance with 10 USC § 101(d) (1). Prior to 2010 only some of the active duty periods less than 30 consecutive days in length were available. In the case of a member of the National Guard, this includes service under a call to active service authorized by the President or the Secretary of Defense under 32 USC § 502(f) for purposes of responding to a national emergency declared by the President and supported by Federal funds. All Active Guard Reserve (AGR) members must be assigned against an authorized mobilization position in the unit they support. This includes Navy Training and Administration of the Reserves (TARs), Marine Corps Active Reserve (ARs) and Coast Guard Reserve Program Administrator (RPAs). Active Duty status also applies to a Uniformed Service member who is an active duty commissioned officer of the U.S. Public Health Service or the National Oceanic and Atmospheric Administration (NOAA Commissioned Corps). Coverage Under the SCRA is Broader in Some Cases Coverage under the SCRA is broader in some cases and includes some categories of persons on active duty for purposes of the SCRA who would not be reported as on Active Duty under this certificate. SCRA protections are for Title 10 and Title 14 active duty records for all the Uniformed Services periods. Title 32 periods of Active Duty are not covered by SCRA, as defined in accordance with 10 USC § 101(d)(1). Many times orders are amended to extend the period of active duty, which would extend SCRA protections. Persons seeking to rely on this website certification should check to make sure the orders on which SCRA protections are based have not been amended to extend the inclusive dates of service. Furthermore, some protections of the SCRA may extend to persons who have received orders to report for active duty or to be inducted, but who have not actually begun active duty or actually reported for induction. The Last Date on Active Duty entry is important because a number of protections of the SCRA extend beyond the last dates of active duty. Those who could rely on this certificate are urged to seek qualified legal counsel to ensure that all rights guaranteed to Service members under the SCRA are protected WARNING: This certificate was provided based on a last name, SSN/date of birth, and active duty status date provided by the requester. Providing erroneous information will cause an erroneous certificate to be provided.
