Tinker Federal Credit Union v. Wanda J. Pierce

Filed: Feb 24, 2026
Type: CJ

What's This Case About?

Let’s get one thing straight: Wanda J. Pierce did not die. She did not vanish into the wind. She didn’t fake her own death or flee the country with a suitcase full of cash and a new identity. No. She simply stopped paying her loans. And for that, Tinker Federal Credit Union has launched a full-scale legal siege that reads like a corporate thriller — if the thriller was set in Seminole County, Oklahoma, and the only weapon was a spreadsheet.

Tinker Federal Credit Union — yes, named after the Air Force base, yes, technically a “credit union” which sounds wholesome like a church bake sale — is now suing Wanda J. Pierce for just over $10,500. That’s not chump change, sure, but it’s also not Breaking Bad levels of debt. And yet, the filing is so thorough, so zealous, it’s like they’re trying to convict her of financial treason. They’ve attached promissory notes, credit card statements, Truth in Lending disclosures, and even an affidavit swearing that Wanda is not in the military — because apparently, Uncle Sam’s protections don’t apply here. The document is so dense with legal jargon and interest rate calculations, you’d think they were suing her for war profiteering.

So who is Wanda J. Pierce? According to the documents, she’s a 73-year-old woman (born in 1950) who owns her home in Seminole, has lived there for over 21 years, and has been a member of Tinker Federal Credit Union long enough to get three separate pre-approved loan offers in the span of less than a year. She’s not some fly-by-night borrower. She’s the kind of customer banks dream about — loyal, established, with a long-standing relationship. And TFCU didn’t just lend to her once. Oh no. They pursued her. They courted her with cold, calculated financial seduction.

First, in March 2023, they sent her a $4,000 pre-approved loan, calling it a “low fixed” rate of 11.96% — which, by the way, is not low. That’s the kind of rate you get when your credit score has seen better days or when the lender knows you’re desperate. But Wanda took the bait. She endorsed the check. She signed the agreement. She got her $4,000. Then, just nine months later — December 2023 — TFCU hit her again: “Could you use a little extra cash for debt consolidation, holiday shopping or home improvement?” Oh, and by the way, here’s another $5,000 at 11.95%. Because clearly, what Wanda needed was more debt. And she took it. Again. Then, in November 2023 — yes, before the second loan even cleared — she applied for a credit card with a $3,500 limit. Which she also maxed out.

Let that sink in. In the span of ten months, TFCU gave Wanda over $12,500 in credit — most of it at nearly 12% interest — and now they’re shocked, shocked, that she defaulted? It’s like handing someone three flamethrowers and then suing them when the house burns down.

The lawsuit claims Wanda breached three contracts: the first loan ($4,000), now owing $2,548.69; the second loan ($5,000), now owing $4,507.88; and the credit card, now at $3,538.78. That’s a total of $10,555.35 — though they’re only suing for $10,554.20, because apparently, they rounded down out of mercy. Or maybe their spreadsheet glitched. Either way, they want every penny back, plus interest (11.95% per year, both before and after judgment), plus attorney’s fees (up to 15% of the debt, according to Oklahoma law), plus court costs. They’ve even asked the court to order the Oklahoma Employment Security Commission to hand over Wanda’s employment records — a move so aggressive it’s like sending a SWAT team to collect a library fine.

Now, let’s talk about why this is a civil case, not a criminal one. Wanda didn’t steal anything. She didn’t forge documents or lie on her application. She signed contracts, got money, and then stopped paying. That’s not fraud. That’s just… life. Maybe her Social Security check isn’t enough. Maybe she got sick. Maybe her car broke down. Maybe she realized she was drowning and decided to stop feeding the machine. But TFCU doesn’t care. They’ve got clauses. They’ve got cross-collateralization rights. They’ve got the right to offset — meaning, if Wanda has any money in any account with them, they can just take it. And they want the court’s blessing to do it.

What do they want? $10,554.20. Is that a lot? For a credit union, no. It’s a rounding error. For Wanda, probably yes. That’s nearly a year’s worth of Social Security for someone her age. But here’s the kicker: TFCU knew her financial situation. They had her application. They knew her income was from Social Security. They knew she didn’t have a job. They still gave her three separate lines of credit. And now they’re acting surprised she couldn’t keep up?

This case isn’t about justice. It’s about policy. It’s about sending a message: We will come for you. We will audit your life. We will subpoena your employment records. We will prove you’re not a soldier, just in case you try to hide behind the Servicemembers Civil Relief Act. All for a debt that, in the grand scheme of banking, is less than the cost of a used car.

Our take? The most absurd part isn’t that Wanda defaulted. It’s that TFCU thought it was a good idea to keep lending to her after the first loan. This isn’t predatory lending. This is competitive predatory lending — like they were in a race to see who could ruin her finances first. And now, when she finally buckled under the weight of their own generosity, they’re the ones crying foul?

We’re not saying Wanda didn’t agree to the terms. She did. She signed the papers. She cashed the checks. But let’s not pretend this is a case of one responsible party and one deadbeat. This is a credit union that saw an elderly woman on a fixed income and said, “You know what she needs? More debt.” And then, when that predictably collapsed, they reached for the gavel.

We’re rooting for Wanda. Not because she’s innocent. But because someone should be. And if the banking system keeps treating vulnerable people like ATMs with legs, maybe the least we can do is cheer for the one who finally said, “No more.”

This status includes information on a Servicemember or his/her unit receiving notification of future orders to report for Active Duty. The Defense Manpower Data Center (DMDC) is an organization of the Department of Defense (DoD) that maintains the Defense Enrollment and Eligibility Reporting System (DEERS) database which is the official source of data on eligibility for military medical care and other eligibility systems. The DoD strongly supports the enforcement of the Servicemembers Civil Relief Act (50 USC App. § 3901 et seq, as amended) (SCRA) (formerly known as the Soldiers' and Sailors' Civil Relief Act of 1940). DMDC has issued hundreds of thousands of "does not possess any information indicating that the individual is currently on active duty" responses, and has experienced only a small error rate. In the event the individual referenced above, or any family member, friend, or representative asserts in any manner that the individual was on active duty for the active duty status date, or is otherwise entitled to the protections of the SCRA, you are strongly encouraged to obtain further verification of the person's status by contacting that person's Service. Service contact information can be found on the SCRA website's FAQ page (Q35) via this URL: https://scra.dmdc.osd.mil/scra/#/faqs. If you have evidence the person was on active duty for the active duty status date and you fail to obtain this additional Service verification, punitive provisions of the SCRA may be invoked against you. See 50 USC App. § 3921(c). This response reflects the following information: (1) The individual's Active Duty status on the Active Duty Status Date (2) Whether the individual left Active Duty status within 367 days preceding the Active Duty Status Date (3) Whether the individual or his/her unit received early notification to report for active duty on the Active Duty Status Date. More information on "Active Duty Status" Active duty status as reported in this certificate is defined in accordance with 10 USC § 101(d)(1). Prior to 2010 only some of the active duty periods less than 30 consecutive days in length were available. In the case of a member of the National Guard, this includes service under a call to active service authorized by the President or the Secretary of Defense under 32 USC § 502(f) for purposes of responding to a national emergency declared by the President and supported by Federal funds. All Active Guard Reserve (AGR) members must be assigned against an authorized mobilization position in the unit they support. This includes Navy Training and Administration of the Reserves (TARs), Marine Corps Active Reserve (ARs) and Coast Guard Reserve Program Administrator (RPAs). Active Duty status also applies to a Uniformed Service member who is an active duty commissioned officer of the U.S. Public Health Service or the National Oceanic and Atmospheric Administration (NOAA Commissioned Corps). Coverage Under the SCRA is Broader in Some Cases Coverage under the SCRA is broader in some cases and includes some categories of persons on active duty for purposes of the SCRA who would not be reported as on Active Duty under this certificate. SCRA protections are for Title 10 and Title 14 active duty records for all the Uniformed Services periods. Title 32 periods of Active Duty are not covered by SCRA, as defined in accordance with 10 USC § 101(d)(1). Many times orders are amended to extend the period of active duty, which would extend SCRA protections. Persons seeking to rely on this website certification should check to make sure the orders on which SCRA protections are based have not been amended to extend the inclusive dates of service. Furthermore, some protections of the SCRA may extend to persons who have received orders to report for active duty or to be inducted, but who have not actually begun active duty or actually reported for induction. The Last Date on Active Duty entry is important because a number of protections of the SCRA extend beyond the last dates of active duty. Those who could rely on this certificate are urged to seek qualified legal counsel to ensure that all rights guaranteed to Service members under the SCRA are protected WARNING: This certificate was provided based on a last name, SSN/date of birth, and active duty status date provided by the requester. Providing erroneous information will cause an erroneous certificate to be provided. Late Charges: If any payment or portion of payment you make is more than ten (10) days past its due date, you will be charged the greater of $20.50 or 5% of the unpaid amount of the scheduled monthly payment. Subject to applicable laws and TFCU rights, no late charge will be assessed on any payment when the delinquency is caused solely by a late fee assessed on earlier payments, and the payment received would otherwise be a full payment under the terms of this Loan. Security: Unless you are a covered borrower under the Military Lending Act or as prohibited by applicable law, you are giving us an additional security interest in collateral that may be securing other loans with us. Contract Terms: You should refer to the Loan Agreement and Disclosure Statement and other contract documents for additional information about nonpayment, default, required repayment before the scheduled date, prepayment limitations, refunds, and penalties. e = estimate Payments: You promise to make payments of the amount and at the time shown in the Truth in Lending Disclosures above until what you owe has been repaid. If you prepay part of what you owe, subsequent payments will remain due as scheduled. Your last payment will be the remaining principal balance plus accrued interest. You promise to make payments to us at the address we choose. You are allowed to prepay your loan balance and make monthly payments early without penalty; however, the "due date" for your next payment will not advance more than ninety (90) days. You are expected to make and continue to make and/or schedule a payment each month to meet the requirements of your loan agreement with us and to avoid default until your loan is paid in full. If this loan refinances another loan we have with you, the other loan will be canceled and refinanced as of the date of this loan. Unless otherwise required by law, payments will be applied to amounts owed in the manner we choose. Interest: You agree to pay interest on the daily balance of the Loan, beginning on the day we receive the endorsed Check and until your Loan is repaid in full, including after default and acceleration. The interest will be computed on the basis of a 365-day year and the actual number of days elapsed. Payments will be applied to: other charges, interest and then principal. Nature of Your Responsibilities: We can enforce this Agreement against you or any of your heirs, executors, or legal representatives. You may not assign or transfer this agreement to anyone. We may assign or transfer this Agreement and the rights or obligations under this Agreement to anyone without your consent, although we will send you notice of an assignment or transfer, if we do. All checks must bear the original signature/endorsement of the person whose name appears on this offer, which is subject to verification by us. Returned Check Charge: If a check or other instrument you use to make a payment on this Agreement is returned to you unpaid for any reason, you agree to pay us a returned loan payment fee of $20.00. Security Agreement: Subject to you being a covered borrower under the Military Lending Act or as otherwise prohibited by applicable laws, you hereby grant us all rights to secure this Loan by a security interest to the extent created by this Loan and this Loan is cross-collateralized by personal property, which secures any debt you have with us now or later, other than household goods. We may use any collateral secured by other loans you have with us, subject to you being a covered borrower under the Military Lending Act or as otherwise prohibited by applicable laws and your right of rescission. The security interest secures the Loan and any extensions, renewals, or refinancing of the Loan. Default and Remedies: You will be in default if: (i) you fail to pay or keep any promise on this Loan, this Agreement, or any other loan or agreement you have with us; (ii) you die, file for bankruptcy, or become insolvent; (iii) you make any false or misleading statements in any statement of credit information; (iv) something happens which we believe may substantially reduce your ability to repay what you owe; or (v) you default, we can require immediate payment of the entire unpaid principal balance of the Loan, without giving you advance notice (called "Accelerate"). If we Accelerate the Loan payment, you will continue to pay interest at the same interest rate until what you owe has been repaid in full. For a default under this Agreement, TFCU reserves all rights under the terms of this Agreement, other agreements with you for debts owed to TFCU, and under applicable laws. You acknowledge that we rely on the statutory right of offset, except as to excluded accounts. We can also exercise any other rights under applicable laws and statutes when you are in default. If you default on the Loan or this Agreement, you will be liable and will be required to pay all reasonable costs, expenses, and fees we may incur in connection with collecting any money you owe us for the Loan, including attorneys' fees up to fifteen percent of the amount in default or as provided by applicable state statute and applicable laws. Waivers: We can delay enforcing any of our rights any number of times without losing our rights. You hereby waive demand, presentment, protest, notice of dishonor, and notice of protest.
