TINKER FEDERAL CREDIT UNION v. ANDREW E. BOON

Filed: Jan 27, 2025
Type: CJ

What's This Case About?

Let’s get one thing straight: Andrew E. Boon did not vanish into the wind after borrowing nearly $15,000 from Tinker Federal Credit Union. He didn’t fake his own death, flee the country, or launch a crypto scam. No, his crime — in the eyes of the law — was far more mundane, yet somehow just as dramatic: he stopped paying his bills. And now, the full weight of Cotton County’s civil justice system is being brought to bear over a stack of promissory notes, a 14-year-old credit card account, and a paper trail so thick it could double as kindling.

So who is Andrew E. Boon? Well, based on the documents, he’s a man who once had excellent credit — at least according to Tinker Federal Credit Union, the financial institution nestled deep in the heart of Tinker Air Force Base country. He lives in Temple, Oklahoma, a town so small it barely registers on most maps, and for a while, he played the game right. He had a job — listed as a “Principle Tech” at Halliburton, no less, which sounds like something out of a spy novel — and he earned a solid monthly income. He even filed for bankruptcy once, way back in December 1999, a full quarter-century ago. That’s ancient history in credit scoring years. By 2010, TFCU was willing to hand him a credit card. By 2021, they were mailing him pre-approved loan checks like he was some kind of financial VIP.

And let’s talk about those checks. Because this isn’t some shady payday lender operating out of a strip mall. This is a federally chartered credit union sending actual paper checks in the mail — $5,000 in June 2021, another $6,000 in July 2022 — with a note that basically says, “Here’s free money, just sign and deposit.” It’s like winning a contest you didn’t enter, except you’re legally obligated to pay it back. And for a while, Boon did. He signed the loan agreements, endorsed the checks, and presumably used the cash for things like debt consolidation, vacations, or home improvements — the very reasons TFCU suggested in their glossy offer letter. The first loan came with a Truth in Lending disclosure that spelled out everything: 60 payments of $106.14, 9.95% APR, total payoff of $6,367.80. It was all very official. Very adult. Very… normal.

But then, somewhere between 2022 and 2024, the payments stopped. Not all at once — that would be too dramatic — but gradually, like a faucet dripping its last. By December 2, 2024, TFCU claimed Boon owed $2,378.08 on the first loan, $4,100.41 on the second, and a whopping $14,020.29 on his credit card, opened way back in 2010. That’s right — this card has been accruing interest for fourteen years. Fourteen years of late fees, compounding interest, and possibly one very sad-looking MasterCard Gold card buried at the bottom of a junk drawer. The total? $14,767.80 — not quite $15K, but close enough to make for a decent headline.

Now, why are we in court? Because TFCU, bless their bureaucratic hearts, followed the playbook. They sent demand letters. They calculated the interest (9.95%, thank you very much). They even checked the Department of Defense database to confirm Boon isn’t in the military — a required step under the Servicemembers Civil Relief Act, because you can’t just sue a deployed soldier over a credit card bill. (Spoiler: he’s not in the military. The affidavit is very thorough. It even has a “Certificate ID”: 93ZN90NW9L8YXH2. Very official.) They’ve invoked Oklahoma law, cited their right to attorney’s fees (up to 15% of the amount in default, because of course they did), and even requested that the state employment commission hand over Boon’s job info. This is not a casual “hey, can you pay us back?” This is a full-scale financial audit disguised as a civil complaint.

What do they want? Money. Specifically, $14,767.80, plus interest, plus fees, plus costs. Is that a lot? In the grand scheme of civil lawsuits, it’s not exactly massive — no yachts or offshore accounts here — but for a guy living in Temple, Oklahoma, on a Halliburton tech salary, it’s not nothing. That’s a used car. A year of rent. A solid chunk of retirement savings. And let’s not forget: this isn’t just one bad month. This is years of unpaid debt, multiple contracts, and a financial relationship that clearly broke down long before the lawsuit was filed.

Here’s the thing we can’t stop thinking about: the sheer banality of it all. This isn’t a heist. It’s not fraud. It’s not even a dramatic overspend on Amazon. This is just life — the slow creep of debt, the missed payments, the credit card that never gets paid off, the loans that get refinanced into more loans until one day, you just… stop. Maybe Boon lost his job. Maybe medical bills piled up. Maybe he decided, “Screw it, I’m done.” We don’t know. The filing doesn’t say. All we know is that a man who once had “excellent credit history” now has a court case with a docket number and an attorney named Jeffery S. Ludlam, who probably has to deal with this kind of thing all day, every day.

And yet, there’s something almost poetic about the way TFCU handled this. The pre-approved loan letters read like love letters from a bygone era — “Could you use a little extra cash?” — only to end in a cold, legal demand for repayment. The credit card application, signed back in 2010, lists Boon’s address, his phone number, even his student status (yes, he was a full-time student once). It’s a time capsule of financial hope, now weaponized against him in a district court filing.

Are we rooting for Andrew Boon? Not exactly. He signed the contracts. He cashed the checks. He agreed to the terms. But are we a little sad that the American dream — get a job, build credit, borrow responsibly — can collapse into a $14,767.80 judgment over two loans and a credit card? Yeah. A little. Because if this can happen to a guy with a Halliburton job and a pre-approved loan offer, it can happen to any of us. And that’s the real crime here — not the breach of contract, but the quiet, unglamorous way ordinary life can tip into financial disaster, one missed payment at a time.

We’re entertainers, not lawyers. But if this case goes to trial, we’re bringing popcorn. And maybe a copy of the Truth in Lending Disclosure, just for ambiance.

The DoD strongly supports the enforcement of the Servicemembers Civil Relief Act (50 USC App. § 3901 et seq, as amended) (SCRA) (formerly known as the Soldiers' and Sailors' Civil Relief Act of 1940). DMDC has issued hundreds of thousands of “does not possess any information indicating that the individual is currently on active duty” responses, and has experienced only a small error rate. In the event the individual referenced above, or any family member, friend, or representative asserts in any manner that the individual was on active duty for the active duty status date, or is otherwise entitled to the protections of the SCRA, you are strongly encouraged to obtain further verification of the person's status by contacting that person's Service. This response reflects the following information: (1) The individual’s Active Duty status on the Active Duty Status Date (2) Whether the individual left Active Duty status within 367 days preceding the Active Duty Status Date (3) Whether the individual or his/her unit received early notification to report for active duty on the Active Duty Status Date. More information on "Active Duty Status" Active duty status as reported in this certificate is defined in accordance with 10 USC § 101(d) (1). Prior to 2010 only some of the active duty periods less than 30 consecutive days in length were available. In the case of a member of the National Guard, this includes service under a call to active service authorized by the President or the Secretary of Defense under 32 USC § 502(f) for purposes of responding to a national emergency declared by the President and supported by Federal funds. All Active Guard Reserve (AGR) members must be assigned against an authorized mobilization position in the unit they support. This includes Navy Training and Administration of the Reserves (TARs), Marine Corps Active Reserve (ARs) and Coast Guard Reserve Program Administrator (RPAs). Active Duty status also applies to a Uniformed Service member who is an active duty commissioned officer of the U.S. Public Health Service or the National Oceanic and Atmospheric Administration (NOAA Commissioned Corps). Coverage Under the SCRA is Broader in Some Cases Coverage under the SCRA is broader in some cases and includes some categories of persons on active duty for purposes of the SCRA who would not be reported as on Active Duty under this certificate. SCRA protections are for Title 10 and Title 14 active duty records for all the Uniformed Services periods. Title 32 periods of Active Duty are not covered by SCRA, as defined in accordance with 10 USC § 101(d)(1). Many times orders are amended to extend the period of active duty, which would extend SCRA protections. Persons seeking to rely on this website certification should check to make sure the orders on which SCRA protections are based have not been amended to extend the inclusive dates of service. Furthermore, some protections of the SCRA may extend to persons who have received orders to report for active duty or to be inducted, but who have not actually begun active duty or actually reported for induction. The Last Date on Active Duty entry is important because a number of protections of the SCRA extend beyond the last dates of active duty. Those who could rely on this certificate are urged to seek qualified legal counsel to ensure that all rights guaranteed to Service members under the SCRA are protected WARNING: This certificate was provided based on a last name, SSN/date of birth, and active duty status date provided by the requester. Providing erroneous information will cause an erroneous certificate to be provided. 07/08/22 ANDREW E BOON PO BOX 64 TEMPLE, OK 73568-0064 Dear Andrew: Thank you for taking advantage of our recent pre-approved loan offer.
