Meet Donnie Yocham: certified installer of on-site sewage treatment systems in Oklahoma, license number 593, and apparently the human embodiment of “I’ll do it later.” The State of Oklahoma, via its Department of Environmental Quality (DEQ), has been chasing him through the legal system like a sitcom dad chasing a runaway lawnmower — yelling, flailing, paperwork flying everywhere. And for what? Because Donnie kept installing septic systems like a cowboy building fences: fast, loose, and without asking permission.

The story starts in 2021, when DEQ first noticed that several systems installed by Donnie lacked the required final inspections — the bureaucratic equivalent of forgetting to sign your name on the dotted line after building a house. No big deal, right? Just submit the form, pay the $30 late fee, and move on. But Donnie didn’t. He repeatedly didn’t. In fact, by January 2022, DEQ had slapped him with his first Administrative Compliance Order (ACO) — basically a “Hey, Donnie, get your act together” letter — demanding he submit inspections for multiple properties and pay a $1,000 penalty. He paid the thousand bucks, sure, but the compliance? Meh. Not so much.

And so the dance began. Every time DEQ issued a warning, Donnie would fix some things, ignore others, and then go install more systems without permits, inspections, or notifications. It was like whack-a-mole, but the mole was a septuagenarian plumber with a backhoe and a disregard for bureaucratic timelines.

By April 2024, DEQ had had enough. They issued ACO Case No. 23-021, tacking on a staggering $84,000 penalty — yes, eighty-four grand — for a laundry list of violations: failing to notify DEQ before starting work, not submitting final inspections, skipping soil tests, and installing systems without proper authorization. This wasn’t just negligence; it was a pattern. A lifestyle.

And still, Donnie kept going. In January 2025, DEQ found yet another system he’d installed in Wagoner County — fully operational, homeowners living in the house for over a year — but no final inspection, no compliance, no paperwork. Just poop and promises. So they slapped him with another ACO in September 2025, this time for $10,500. By this point, the man wasn’t just behind on forms — he was running a rogue sewage installation empire.

Now, let’s talk about what these violations actually mean. This isn’t just about red tape. On-site sewage systems — especially aerobic spray types — need proper oversight because when they fail, they fail disgustingly. We’re talking contaminated groundwater, stinky runoff, potential health hazards. The rules exist so your neighbor’s backyard doesn’t become a biohazard zone because someone skipped a soil test. Donnie wasn’t just cutting corners; he was potentially endangering public health. And DEQ wasn’t coming after him for fun — they were trying to stop a ticking time bomb of untreated waste.

But here’s the kicker: Donnie wasn’t some fly-by-night contractor. He was certified. He had a license. He knew the rules. These weren’t isolated incidents — they were systemic, repeated violations across multiple counties, involving dozens of homes. The DEQ isn’t trying to bankrupt Donnie; they’re trying to shut down a chronic offender before someone gets sick. And honestly? $84,000 starts to sound reasonable when you consider the environmental risk.

But here’s what we’re rooting for: not Donnie’s downfall, but his redemption. Maybe he’s overwhelmed. Maybe he’s old-school, thinks permits are for “city folks.” Maybe he just hates computers. But the system only works if everyone plays by the rules — especially the guy handling other people’s sewage. What we want is for Donnie to finally sit down, hire a compliance officer, and say, “You know what? I’ll do the forms.” Because no one wants a septic war. We just want clean water and functioning toilets.

DEPARTMENT OF ENVIRONMENTAL QUALITY, PLAINTIFF vs. DONNIE YOCHAM, DEFENDANT PETITION FOR INJUNCTIVE RELIEF COMES NOW the Plaintiff, the State of Oklahoma ex rel. Department of Environmental Quality ("DEQ"), by and through its attorneys of record, Gary Henry and Scott Raybern, and seeks a permanent injunction to enjoin Defendant Donnie Yocham from unlawfully installing on-site sewage treatment systems; from further violations of the Oklahoma Environmental Quality Code ("Code") at 27A O.S. § 2-1-101 et seq.; the rules promulgated thereunder at Oklahoma Administrative Code ("OAC") Title 252, Chapter 641; and the requirements set forth in the Administrative Compliance Orders ("ACO"): ACO Case Number 21-234, issued January 31, 2022 "See attached hereto as 'Exhibit I'; ACO Case Number 23-021, issued April 1, 2024 "See attached hereto as 'Exhibit 2'; and ACO Case Number 25-194, issued September 19, 2025. "See attached hereto as 'Exhibit 3'. In support, Plaintiff alleges and states as follows: BACKGROUND 1. DEQ is an agency of the State of Oklahoma and is charged with the duty to protect human health and the environment through the enforcement of the provisions of the Code and the rules promulgated thereunder pursuant to 27A O.S. § 1-3-101(B) and 27A O.S. § 2-6-102 et seq. 2. Venue is proper in Oklahoma County pursuant to Title 12 O.S. § 133 as DEQ is located in Oklahoma County, and all official acts of DEQ originate in Oklahoma County. 3. Between April 12, 2021, and February 12, 2025, DEQ identified multiple on-site sewage treatment systems installed by the Defendant which lacked the requisite paperwork. The on-site sewage treatment systems were located at the following properties: a. 27175 Howard Rd., Morris, Okmulgee County, Oklahoma b. 10010 N 340 Rd., Morris, Okmulgee County, Oklahoma c. 21014 W 35th St. N., Haskell, Muskogee County, Oklahoma d. 21746 W Haskell Lake Rd., Haskell, Muskogee County, Oklahoma e. 1195 S. Wichita Ave., Haskell, Muskogee County, Oklahoma f. 21784 W Duncan Rd., Haskell, Muskogee County, Oklahoma g. 20345 W 10th St. N, Haskell, Muskogee County, Oklahoma h. 21825 W Haskell Lake Rd., Haskell, Muskogee County, Oklahoma i. 30 Rd., Haskell, Muskogee County, Oklahoma j. 18301 W 23rd St. S, Haskell, Muskogee County, Oklahoma k. 1695 N 340 Rd., Haskell, Muskogee County, Oklahoma l. 7044 Garfield Rd., Beggs, Okmulgee County, Oklahoma m. 21925 E 104th St. S, Broken Arrow, Wagoner County, Oklahoma n. 2131 E 90th St. N, Wagoner, Wagoner County, Oklahoma 4. On October 2, 2021, DEQ issued NOV Case No. 21-ECLS-NOV-067 concerning the systems on properties located at: 27175 Howard Rd., Morris, Okmulgee County, Oklahoma; 21784 W Duncan Rd., Haskell, Muskogee County, Oklahoma; 20345 W 10th St. N, Haskell, Muskogee County, Oklahoma; and 21825 W Haskell Lake Rd., Haskell, Muskogee County, Oklahoma. The NOV required the violation(s) to be corrected by submitting a final inspection for the properties listed and a response in writing to DEQ explaining how the violation(s) would be prevented in the future, why the Defendant’s certification should not be suspended or revoked, and why the Defendant should not be assessed an administrative penalty. 5. On January 31, 2022, DEQ executed ACO Case No. 21-234, which resolved NOV Case No. 21-ECLS-NOV-067. The ACO directed the Defendant to submit final inspections for all the properties listed, pay the assessed penalty of ONE THOUSAND DOLLARS ($1,000.00), and remain in compliance with DEQ rules and regulations. The ACO became a final order on January 31, 2022. On March 14, 2022, the assessed penalty for ACO 21-234 was paid in full, receipt no. 874092. 6. On April 13, 2022, DEQ issued NOV Case No. 22-ECLS-NOV-008 concerning the system on property located at 18303 W 23rd St. S, Haskell, Muskogee County, Oklahoma and systems on properties listed in ACO Case No. 21-234. The NOV required that the violation(s) be corrected by submitting flow certifications, corrected soil designs, and final inspections for the listed properties and a response in writing to DEQ explaining how the violation(s) would be prevented in the future, why the Defendant’s certification should not be suspended or revoked, and why the Defendant should not be assessed an administrative penalty. 7. On December 23, 2022, DEQ issued NOV Case No. 22-ECLS-NOV-081 concerning the system on property located at 7044 Garfield Rd., Beggs, Okmulgee County, Oklahoma. The NOV required that the violations be corrected by responding in writing to DEQ explaining how the violation(s) will be prevented in the future, why the Defendant’s certification should not be suspended or revoked, and why the Defendant should not be assessed an administrative penalty. 8. On April 4, 2023, DEQ issued NOV Case No. 23-ECLS-NOV-012 concerning the systems on properties located at: 10010 N 340 Rd., Morris, Okmulgee County, Oklahoma; 21014 W 35th St. N., Haskell, Muskogee County, Oklahoma; 21746 W Haskell Lake Rd., Haskell, Muskogee County, Oklahoma; 1195 S. Wichita Ave., Haskell, Muskogee County, Oklahoma; 30 Rd., Haskell, Muskogee County, Oklahoma; and 1695 N 340 Rd., Haskell, Muskogee County, Oklahoma. The NOV required the violation(s) be corrected by submitting a flow certification, soil profile, and final inspection for the properties listed and a response in writing to DEQ explaining how the violation(s) will be prevented in the future, why the Defendant’s certification should not be suspended or revoked, and why the Defendant should not be assessed an administrative penalty. 9. On October 18, 2023, DEQ issued NOV Case No. 23-ECLS-NOV-064 concerning the system on property located at 21925 E 104th St. S, Broken Arrow, Wagoner County, Oklahoma. The NOV required the violation(s) be corrected for the listed property by submitting a flow certification and soil profile; obtaining an Authorization to Construct or Modify an On-Site Sewage Treatment System ("ATC"); requesting a DEQ-final inspection; and a response in writing to DEQ explaining how the violation(s) will be prevented in the future and why the Defendant should not be assessed an administrative penalty. 10. On April 1, 2024, DEQ executed ACO Case No. 23-021, encompassing violations from NOV Case Nos: 22-ECLS-NOV-008, issued April 13, 2022; 22-ECLS-NOV-081, issued December 13, 2022; 23-ECLS-NOV-012, issued April 4, 2023; and 23-ECLS-NOV-064, issued October 18, 2023. The ACO directed the Defendant to submit to DEQ all flow certifications, soil profiles, ATCs, and final inspections for all the properties listed, pay the assessed penalty of EIGHTY-FOUR THOUSAND DOLLARS ($84,000.00), and remain in compliance with all DEQ and OAC rules and regulations. The ACO became a final order on April 1, 2024. 11. On April 24, 2025, DEQ issued NOV Case No. 25-ECLS-NOV-010 concerning the system on property located at 2131 E 90th St., N, Wagoner, Wagoner County, Oklahoma. The NOV required the documented violation(s) be corrected, requesting a DEQ-final inspection for the listed property, and a response in writing to DEQ explaining how the violation(s) will be prevented in the future, and why the Defendant should not be assessed an administrative penalty. 12. On November 13, 2024, the Defendant submitted to DEQ the previously missing requisite paperwork for systems on properties located at 10010 N 340 Rd., Morris, Okmulgee County, Oklahoma; 21014 W 35th St. N, Haskell, Muskogee County, Oklahoma; 21746 W Haskell Lake Rd., Haskell, Muskogee County, Oklahoma; 1195 S Wichita, Haskell, Muskogee County, Oklahoma; and 1695 N 340 Rd., Haskell, Muskogee County, Oklahoma, thereby fulfilling the requirements of NOV Case No. 23-ECLS-NOV-012 for the listed properties. 13. On September 19, 2025, DEQ executed ACO Case No. 25-194, which resolved NOV Case No. 25-ECLS-NOV-010. The ACO directed the Defendant to correct any documented violation(s), request a DEQ final inspection, pay the assessed penalty of TEN THOUSAND FIVE HUNDRED DOLLARS ($10,500.00). The ACO became a final order on September 15, 2025. 14. Plaintiff seeks permanent injunctive relief, enjoining Defendant for violations of 27A O.S. § 2-6-101 et seq., and OAC Title 252, Chapter 641. 15. In addition, DEQ seeks an order compelling Defendant’s compliance with the requirements of the ACO, including the purchase of ATCs, flow certifications, soil profiles, final inspections, and the combined penalties as listed above. 16. Defendant has failed and refused to fully comply with the provisions of the ACO, failed to pay the assessed administrative penalties, and continued to commit violations on multiple properties in Oklahoma. AUTHORITY 17. Sections 2-3-504(A)(4) and (F)(2) of Title 27A of the Oklahoma Statutes authorize the district courts of the State of Oklahoma to grant injunctive relief to compel compliance with the Code, rules promulgated thereunder, and an Order issued pursuant to the Code. Section 2-3-504(F)(2) specifically provides that "[t]he court shall have jurisdiction to determine said action, and to grant the necessary or appropriate relief, including but not limited to mandatory or prohibitive injunctive relief, interim equitable relief, and punitive damages." 27A O.S. § 2-3-504(F)(2). Moreover, § 2-3-504(A)(4) provides that "any person who violates any of the provisions of, or who fails to perform and duty imposed by, the [Code] or who violates any order ... issued by [DEQ] or rule promulgated ... pursuant to this Code ... [m]ay be subject injunctive relief granted by a district court. A district court may grant injunctive relief to prevent a violation of, or to compel compliance with, any of the provisions of this Code or any rule promulgated thereunder or order ...issued pursuant to this Code" 27A O.S. § 2-3-504(A)(4). 18. Defendant has failed and refused to fully comply with the terms of an Order. 19. Defendant has failed and refused to comply with the Code and rules promulgated thereunder. 20. Defendant has violated a lawful order of DEQ, as stated herein, and such violations are continuing and ongoing. DEQ is aggrieved by Defendant’s violation of its lawful order, has exhausted its administrative enforcement process, and has no adequate remedy at law; therefore, injunctive relief is appropriate. 21. Defendant has continuously violated statutes within the Code, as stated herein, and such continuing violations entitle Plaintiff to the requested injunctive relief. See Semke v. State ex rel. Okla. Motor Vehicle Comm’n 1970 OK 15, 465 P.2d 441 (violation of state statute is an injury to state and citizens, and a continuing violation is an irreparable injury for which injunctive relief is available). 22. Plaintiff has a duty to protect human health and the environment, which are in danger and at risk of harm and injury if Defendant continues to violate the ACOs, Code, and rules promulgated thereunder. 23. Irreparable injury will result to the State and its citizens unless the on-going and continuous acts and conduct of the Defendant is enjoined and Defendant is compelled to comply with the provisions of the ACOs, the Code, and rules promulgated thereunder. Such ongoing noncompliance presents imminent and substantial endangerment to health and the environment. 24. Therefore, DEQ requests this court to prohibit Defendant from further violation. DEQ further requests this court to order Defendant to comply with the requirements of the ACO, and payment of the administrative penalty included in the ACO. 25. Pursuant to 12 O.S. § 66, DEQ is entitled to commence this action without bond or payment of costs. WHEREFORE, premises considered, DEQ respectfully requests this Court to grant a permanent injunction enjoining Defendant from violating the provisions of the Oklahoma Environmental Quality Code and rules promulgated thereunder; to compel Defendant's compliance with the ACO; award DEQ its attorney fees and costs; and all other relief this Court deems just and proper. This ACO relates to violations of the Oklahoma Environmental Quality Code, specifically 27A O.S. § 2-6-101 et seq., and Oklahoma Administrative Code ("OAC") Title 252 Chapter 641, Individual and Small Public On-Site Sewage Treatment Systems. This ACO supersedes and closes Notice of Violation ("NOV") 21-ECLS-NOV-067 issued by DEQ on October 2, 2021. Attached hereto as Exhibit A. FINDINGS OF FACT 1. Donnie Yocham ("Respondent") is a Certified (License No. 593) installer of onsite sewage treatment systems. ENFORCEMENT NO. 169243 2. On February 5, 2021, DEQ personnel issued Respondent an Authorization to Construct or Modify an On-site Sewage Treatment System (ATC) to install an on-site sewage treatment system on property located at 25175 Howard Rd, Morris, Okmulgee County, Oklahoma, owned by Sheryl Bourne. 3. On March 8, 2021, DEQ personnel went to the above-described property and observed an on-site sewage treatment system had been installed. 4. On April 13, 2021, DEQ personnel completed a compliance report (DEQ Form 641-003) identifying the above-described violations and requesting the correction of the violations by submitting a complete and accurate final inspection to DEQ by April 27, 2021. 5. On April 15, 2021, DEQ personnel received a final inspection (DEQ Form 641-586A/S) from Respondent for the above-described property. This submission was not approvable. 6. On April 30, 2021, DEQ personnel sent Respondent a follow-up compliance report showing that Respondent had not submitted an approvable final inspection for the above-described property. **ENFORCEMENT No. 170419** 7. On April 21, 2021, DEQ personnel performed a records review of open ATCs. DEQ personnel discovered an ATC issued to Respondent on July 24, 2020, for property located at 21784 W Duncan Rd, Haskell, Muskogee County, Oklahoma, owned by Cliff Shannon. 8. On April 21, 2021, DEQ personnel went to the above-described property and observed an on-site sewage treatment system had been installed without a final inspection being submitted to DEQ. 9. On May 5, 2021, DEQ personnel sent Respondent a compliance report (DEQ Form 641-003) identifying the above-described violations and requesting the correction of the violations by submitting a final inspection to DEQ by May 20, 2021. 10. On June 10, 2021, DEQ personnel sent Respondent follow-up compliance report showing that Respondent had failed to submit a final inspection for the above-described property. ENFORCEMENT No. 170420 11. On April 21, 2021, DEQ personnel performed a records review of open ATC's. DEQ personnel discovered an ATC issued to Respondent on November 20, 2020, for property located at 20345 W 10th St N, Haskell, Muskogee County, Oklahoma, owned by Jim Elliott. 12. On April 21, 2021, DEQ personnel went to the above-described property and observed an on-site sewage treatment system had been installed on the above-described property without a final inspection submitted to DEQ. 13. On May 5, 2021, DEQ personnel sent Respondent a compliance report (DEQ Form 641-003) identifying the above-described violations and requesting the correction of the violations by submitting a final inspection to DEQ by May 20, 2021. 14. On July 19, 2021, DEQ personnel sent Respondent a follow-up compliance report showing that Respondent failed to submit a final inspection for the above-described property. ENFORCEMENT No. 170421 15. On April 21, 2021, DEQ personnel performed a records review of open ATC's. DEQ personnel discovered an ATC issued to Respondent on January 9, 2019, for property located at 21784 W Haskell Lake Rd, Haskell, Muskogee County, Oklahoma, owned by Howard Custom Homes. 16. On April 21, 2021, DEQ personnel went to the above-described property and observed an on-site sewage treatment system had been installed without a final inspection submitted to DEQ. 17. On May 5, 2021, DEQ personnel sent Respondent compliance report (DEQ Form 641-003) identifying the above-described violations and requesting the correction of the violations by submitting a final inspection to DEQ by May 20, 2021. 18. On June 6, 2021, DEQ personnel sent Respondent a follow-up compliance report showing that Respondent had failed to submit a final inspection for the above-described property. 19. On October 2, 2021, DEQ issued NOV 21-ECLS-NOV-067 to Respondent. Respondent received the NOV on November 5, 2021. 20. As of the date of this ACO, Respondent has failed to correct the violations noted above. CONCLUSIONS OF LAW DEQ has regulatory jurisdiction and authority in this matter, and Respondent is subject to the jurisdiction and authority of DEQ under 27A O.S. § 1-3-101(B) and 2-6-101, et. seq. and OAC 252:641. 21. OAC 252:641-21-12(a) states in part (a) Systems installed. For each new installation, modification or repair self-inspected and approved a certified installer shall comply with the following: (1) Notify DEQ. The installer must give DEQ an opportunity to inspect a portion of the system to ascertain that the certified installer continues to meet certification requirements. The certified installer shall notify the local DEQ office, before construction begins, of the time, date and location that an on-site sewage treatment system will be installed, modified or repaired. The installer shall pay DEQ a Fifty-Dollar ($50.00) fee each time the installer fails to notify the DEQ prior to commencing construction. (2) Submittals to DEQ. Within fifteen (15) working days after the work has been completed, the certified installer shall submit an accurate, completed DEQ Form 641-576A or 641-576S to the local DEQ office. The installer shall pay DEQ a Thirty Dollar ($30.00) fee each time the installer fails to submit a completed DEQ Form 641-576A or 641-576S within fifteen (15) days of completing the work. DEQ alleges a violation of 252:641-21-12(a) for failing to notify DEQ prior to installation and for failing to submit a final inspection (DEQ form 641-576A/S) for the above-described properties. ORDER 22. Based on the above paragraphs, the Executive Director orders as follows: A. The Respondent shall, within thirty (30) days of receipt of this ACO, submit to DEQ final inspection (DEQ Form 641-567) for all of the above referenced properties. B. The Respondent shall, within thirty (30) days of receipt of this ACO, submit payment of the assessed penalty as listed in paragraph 23. C. The Respondent shall remain in compliance with DEQ rules and regulations. 23. The Oklahoma Environmental Quality Code, 27A O.S. §§ 2-3-502(B) and (K) authorizes DEQ to seek penalties of up to TEN THOUSAND DOLLARS ($10,000.00) per day for each violation of the associated rules. Based on the facts and circumstances of this case, DEQ assesses a total penalty of ONE THOUSAND DOLLARS ($1,000.00) (invoice enclosed). Respondent shall submit payment for the penalty within thirty (30) days of receipt of this ACO. Payment shall be by check or money order payable to the Oklahoma Department of Environmental Quality (or DEQ), showing the Case Number of this ACO, and delivered to: Accounts Receivable Financial & Human Resources Management Department of Environmental Quality P.O. Box 2036 Oklahoma City, OK 73101-2036 24. If Respondent has any further violations after the execution of this ACO, Respondent may be subject to additional penalties and escalated enforcement. 25. If Respondent fails to pay any penalty, DEQ may bring a separate action for collection of the penalty in district court. An action by DEQ for the collection of a penalty does not affect Respondent’s duty to complete the tasks required by this ACO. GENERAL PROVISIONS 26. Respondent shall allow agents of DEQ entry onto Respondent’s property, at reasonable times and without advance notice, for the purposes of inspecting, sampling, testing, records review, and other authorized activities to assess compliance with Oklahoma statutes and rules and this ACO. 27. The installer shall pay DEQ a Thirty Dollar ($30.00) fee each time the installer fails to submit a completed DEQ Form 641-576A or 641-576S within fifteen (15) days of completing the work. DEQ personnel were unable to locate a final inspection (DEQ Form 641-576A/S) for the above-described property. 3. On April 12, 2021, DEQ personnel went to the above-described property and observed two separate residences, each with aerobic spray on-site sewage treatment systems installed on the property. 4. On April 21, 2021, DEQ personnel went to the above-described property and observed the on-site sewage treatment system was installed and in use. 23. On May 3, 2021, DEQ personnel spoke to Respondent regarding the above-described violation and made him aware that a compliance report would be issued. 24. On May 3, 2021, DEQ personnel issued Respondent a compliance report identifying a failure to notify DEQ on the day construction began and a failure to submit a final inspection within fifteen (15) days of installing the on-site sewage treatment system and requesting the correction of the violations by submitting the final inspection by May 20, 2021. On June 10, 2021, DEQ personnel issued Respondent a follow-up compliance report identifying the above-described violations and noting the final inspection had not been submitted. Attached hereto as "Exhibit 10" of "Exhibit C". ENFORCEMENT NO. 172914 26. On December 16, 2021, DEQ personnel performed a records review of open Authorizations to Construct or Modify an On-site Sewage Treatment System ("ATC"). DEQ personnel discovered an ATC requested by Respondent for property located at 18031 W 23rd St S, Haskell, Muskogee County, Oklahoma, owned by Kevin Kelley. 27. On December 17, 2021, DEQ personnel went to the above-described property and observed an on-site sewage treatment system had been installed on the south side of the property. 28. On December 17, 2021, DEQ personnel spoke to Mr. Kelley, who confirmed that Respondent installed the on-site treatment system on the above-described property. 29. On December 27, 2021, DEQ personnel received a soil design from Respondent for the above-described property. Upon review, DEQ personnel observed several deficiencies on the submitted soil design. DEQ personnel emailed Respondent requesting the soil design be corrected and re-submitted to DEQ. 30. On January 10, 2022, DEQ personnel sent Respondent a compliance report (DEQ Form 641-003) identifying the above-described violations and requesting the correction of the violations by submitting a flow certification, corrected soil design, and a final inspection by January 24. 2022. Attached hereto as “Exhibit E”. 31. On January 25, 2022, DEQ personnel sent Respondent a follow-up compliance report identifying the above-described violations had not been corrected. Attached hereto as “Exhibit F”. 32. On April 13, 2022, DEQ issued NOV Case No. 22-ECLS-NOV-008 to Respondent for Enforcement No. 172914. Respondent received the NOV on April 29, 2022, as evidenced by a United States Postal Service (“USPS”) tracking notification. The NOV required that the violations be corrected by submitting a flow certification, a corrected soil design, a final inspection to DEQ for the above-described property in Enforcement No. 172914 and responding in writing to DEQ explaining how Respondent would prevent this type of violation in the future, why his certification should not be suspended or revoked, and why he should not be accessed an administrative penalty. *USPS tracking notification attached hereto as "Exhibit G"*. 33. On May 23, 2023, DEQ personnel spoke to Respondent regarding submitting the required documentation and response to NOV Case No. 22-ECLS-NOV-008. 34. On June 1, 2022, DEQ personnel received a response from Respondent, and it was determined that the response was insufficient. ENFORCEMENT NO. 177126 35. On August 22, 2022, DEQ personnel performed a records search for on-site sewage treatment system documents for property located at 1695 N 340 Rd, Haskell, Muskogee County, Oklahoma. DEQ personnel were unable to locate a soil test, an issued ATC, or final inspection (DEQ Form 641-576A/S) for the above-described property. 36. On August 26, 2022, DEQ personnel went to the above-described property and observed an on-site sewage treatment system was installed and in use. DEQ personnel spoke to the property owner who stated that Respondent had installed the on-site sewage treatment system. 37. On August 29, 2022, DEQ personnel mailed and emailed Respondent a compliance report identifying the above-described violations, noting that he also failed to notify DEQ on the day construction of the on-site sewage treatment system began, and requesting the correction of the violations by completing a final inspection by September 12, 2022. *Attached hereto as "Exhibit 11" of "Exhibit C"*. 38. On September 13, 2022, DEQ personnel issued Respondent a follow-up compliance report identifying the above-described violations and noting the final inspection had not been submitted. *Attached hereto as "Exhibit 12" of "Exhibit C"*. ENFORCEMENT NO. 177436 39. On September 30, 2022, DEQ personnel discovered the installation of an unapproved on-site sewage treatment system on property located at 7044 Garfield Road, Beggs, Okmulgee County, Oklahoma, owned by Sara Calvert. 40. On September 30, 2022, DEQ personnel performed a records search of on-site sewage treatment system documents for the above-described property but were unable to locate any. 41. On October 3, 2022, DEQ personnel spoke to Mrs. Calvert, who stated that AJ Yocham had installed the on-site sewage treatment system, but she had emailed all the needed paperwork to Respondent. 42. On October 3, 2022, DEQ personnel spoke to AJ Yocham, who stated that Respondent installed the on-site sewage treatment system and was responsible for submitting the paperwork to DEQ. 43. On October 4, 2022, DEQ personnel received an email from Respondent with the system design, flow certification, and the final inspection for the above-described property. 44. On October 5, 2022, DEQ personnel sent Respondent a compliance report (DEQ Form 641-003) identifying the above-described violations and requesting the correction of the violations by obtaining an ATC and submitting a corrected final inspection (DEQ Form 641-576A/S) by October 19, 2022. Attached hereto as "Exhibit I" of "Exhibit B". 45. On October 5, 2022, DEQ personnel received and issued the ATC. 46. On October 6, 2022, DEQ personnel received a corrected final inspection (DEQ Form 641-576A/S) and issued the final inspection. 47. On October 7, 2022, DEQ personnel sent Respondent a follow-up compliance report showing that he had corrected the violations for the above-described property. Attached hereto as "Exhibit 2" of "Exhibit B". 48. On December 23, 2022, DEQ issued NOV Case No. 22-ECLS-NOV-081 to Respondent for Enforcement No. 177436. Respondent received the NOV on May 2, 2023, as evidenced by a USPS tracking notification. The NOV required that the violations be corrected by responding in writing to DEQ explaining how Respondent will prevent these types of violations in the future, why his certification should not be suspended or revoked, and why he should not be assessed an administrative penalty. On April 4, 2023, DEQ issued NOV Case No. 23-ECLS-NOV-012 to Respondent for Enforcement Nos. 169242, 170416, 170417, 170418, 170422, and 177126. Respondent received the NOV on April 13, 2024, as evidenced by a USPS tracking notification. The NOV required that the violations be corrected by submitting a flow certification, soil profile, completing a final inspection for the above-described property, responding in writing to DEQ explaining how Respondent would prevent these types of violations in the future, why his certification should not be suspended or revoked, and why he should not be assessed an administrative penalty. On July 17, 2023, DEQ personnel received a complaint regarding the unapproved installation of an on-site sewage treatment system on property located at 21925 E 104th St S, Broken Arrow, Wagoner County, Oklahoma, in the Charleston Estates subdivision. 51. On July 17, 2023, DEQ personnel went to the above-described property and observed an on-site sewage treatment system had been installed. While at the property, DEQ personnel met with the property owner who stated that they believe Respondent installed the on-site sewage treatment system and that there had been no one on the property to service the system. The property owner also stated that Mullins Plumbing had been contacted to perform maintenance on the on-site sewage treatment system and that, since having Mullins Plumbing perform maintenance, there had been no issues. The property owner’s home was built by Cozort Homes. 52. On July 30, 2023, DEQ personnel performed a records search of on-site sewage treatment system documentation for the above-described property. No records for the on-site sewage treatment were on file. As such, the on-site sewage treatment system was installed without a flow certification and soil test, without obtaining an Authorization to Construct or Modify an On-site Sewage Treatment System ("ATC") from DEQ, and without requesting a DEQ final inspection. 53. On September 19, 2023, DEQ personnel confirmed that Cozort Homes built many homes within the Charleston Estates subdivision and that the majority of homes on E 104th St S were built by them. 54. On October 9, 2023, DEQ personnel confirmed that Respondent installed the on-site sewage treatment system on the above-described property and that he installed the majority of the on-site sewage treatment systems for Cozort Homes in the Charleston Estates subdivision. 55. On October 18, 2023, DEQ issued NOV Case No. 23-ECLS-NOV-064 to Respondent for Enforcement No. 181600. Respondent received the NOV on October 23, 2023, as evidenced by a USPS tracking notification. The NOV required that the violations be corrected by submitting a flow certification, soil profile, obtaining an ATC, completing a final inspection for the above-described property, responding in writing to DEQ explaining how Respondent would prevent these types of violations in the future, why his certification should not be suspended or revoked, and why he should not be assessed an administrative penalty. USPS tracking notification attached hereto as "Exhibit J" 56. As of the date of this ACO, Respondent has failed to submit all flow certifications, soil profiles, and complete final inspections for all of the above-described properties, respond in writing to DEQ to NOV Case No. 23-ECLS-NOV-012 and NOV Case No. 23-ECLS-NOV-064 explaining how he would prevent these types of violations in the future, why his certification should not be suspended or revoked, and why he should not be assessed an administrative penalty. CONCLUSIONS OF LAW 57. DEQ has regulatory jurisdiction and authority in this matter, and Respondent is subject to the jurisdiction and authority of DEQ under 27A O.S. §§ 1-3-101(B) and 2-6-101, et. seq. and OAC 252:641. 58. OAC 252:641-1-2.1(a) and (b) states in part: (a) Requirement for authorizations and permits. Before installing a new or modifying an existing on-site sewage treatment system, the installer shall first obtain either: (1) DEQ authorization to construct an on-site sewage treatment system under the general permit, the terms of which are the rules of this Chapter; or (2) an individual permit to construct an alternative on-site sewage treatment system. (b) Applying for authorizations; necessity for permit. (1) An installer seeking an authorization to construct a new or modify an existing on-site sewage treatment system shall submit a completed and signed: (A) DEQ Form 641-575, "Request for Authorization/Permit to Construct an On-Site Sewage Treatment System" along with the appropriate fee(s) [see 252:641-23 (relating to fees)] to DEQ's Oklahoma City office; (B) DEQ Form 641-581P or 641-581SP "Report for On-Site Sewage" to the local DEQ office. The detail needed varies with each system design; guidance will be provided by the local DEQ office; and (C) DEQ Form 641-581Cert "Certification Documentation Form" to the local DEQ office. DEQ alleges Respondent is in violation of OAC 252-641-1-2.1 (a) and (b) for failing to submit flow certifications and soil profiles, and obtain ATCs for the on-site sewage treatment systems Respondent installed on the above-described properties. 59. OAC 252:641-21-12(a) states in part (a) Systems installed. For each new installation, modification or repair self-inspected and approved a certified installer shall comply with the following: (1) Notify DEQ. The installer must give DEQ an opportunity to inspect a portion of the system to ascertain that the certified installer continues to meet certification requirements. The certified installer shall notify the local DEQ office, before construction begins, of the time, date and location that an on-site sewage treatment system will be installed, modified or repaired. The installer shall pay DEQ a Fifty-Dollar ($50.00) fee each time the installer fails to notify the DEQ prior to commencing construction. (2) Submittals to DEQ. Within fifteen (15) working days after the work has been completed, the certified installer shall submit an accurate, completed DEQ Form 641-576A or 641-576S to the local DEQ office. The installer shall pay DEQ a Thirty Dollar ($30.00) fee each time the installer fails to submit a completed DEQ Form 641-576A or 641-576S within fifteen (15) days of completing the work. DEQ alleges Respondent is in violation of 252:641-21-12(a) for failing to notify DEQ prior to installation and for failing to submit final inspections (DEQ form 641-576A/S) for the above-described properties. ORDER 60. Based on the above paragraphs, the Executive Director orders as follows: a. Respondent shall, within thirty (30) days of receipt of this ACO, submit to DEQ all flow certifications, soil profiles, ATCs, and final inspections (DEQ Form 641-567) for all of the above-referenced properties. b. Respondent shall, within thirty (30) days of receipt of this ACO, submit payment of the assessed penalty as listed in paragraph 63. c. Respondent shall remain in compliance with all DEQ and OAC rules and regulations. 61. The Oklahoma Environmental Quality Code, 27A O.S. § 2-3-502(B) and (K) authorizes DEQ to seek penalties of up to TEN THOUSAND DOLLARS ($10,000.00) per day for each violation of the associated rules. Based on the facts and circumstances of this case, DEQ assesses a total penalty of EIGHTY-FOUR THOUSAND DOLLARS ($84,000.00) (invoice enclosed). Respondent shall submit payment for the penalty within thirty (30) days of receipt of this ACO. Payment shall be by check or money order payable to the Oklahoma Department of Environmental Quality (or DEQ), showing the Case Number of this ACO, and delivered to: Accounts Receivable Financial & Human Resources Management Department of Environmental Quality PO Box 2036 Oklahoma City, OK 73101-2036 62. If Respondent has any further violations after the execution of this ACO, he may be subject to additional penalties and escalated enforcement. 63. If Respondent fails to pay any penalty, DEQ may bring a separate action for collection of the penalty in district court. Any action by DEQ for the collection of a penalty does not affect Respondent’s duty to complete the tasks required by this ACO. GENERAL PROVISIONS 64. Respondent shall allow agents of DEQ entry onto his property, at reasonable times and without advance notice, for the purposes of inspecting, sampling, testing, records review, and other authorized activities to assess compliance with Oklahoma statutes and rules and this ACO. 65. This ACO is in addition to any other remedies provided by law and does not preclude DEQ from seeking other relief as appropriate. NOTICE OF OPPORTUNITY TO REQUEST HEARING 66. This ACO is entered under the authority of 27A O.S. § 2-3-502. This ACO will automatically become final unless, no later than fifteen (15) days after it is served, Respondent submits to DEQ a written request to review this ACO. The scope of the hearing will be limited to the matters raised in the request for hearing, unless otherwise permitted by the Administrative Law Judge for good cause. The hearing will be conducted in accordance with the Oklahoma Administrative Procedures Act. The Administrative Law Judge may schedule pre-hearing conferences as deemed necessary. 68. Respondent may be present and/or represented by an attorney at the hearing. Respondent or counsel may present evidence and argument to show why this ACO should be set aside, or modified. 69. On the basis of the hearing record, the Executive Director of DEQ will sustain, set aside, or modify the ACO. NOTICE OF OPPORTUNITY TO DISCUSS SETTLEMENT 70. Regardless of whether Respondent requests a hearing, he may confer with the Environmental Complaints and Local Services Division regarding a settlement. A settlement conference may be pursued simultaneously with, or as an alternative to, the hearing process, but a request for a settlement conference does not extend the fifteen (15) day period to request a hearing. Respondent may be present and/or represented by an attorney at a settlement conference. 71. Any settlement reached by the parties shall be finalized in the form of a written Consent Order ("CO") signed by Respondent and the DEQ Executive Director. The issuance of a CO waives Respondent's right to pursue a hearing on any issue covered by the CO. 72. On October 4, 2022, DEQ personnel received an email from you with the system design, flow certification, and the final inspection for the above-described property. On October 5, 2022, DEQ personnel sent you a compliance report (DEQ Form 641-003) identifying the above-described violations and requesting the correction of the violations by obtaining an Authorization to Construct or Modify an On-Site Sewage Treatment System ("ATC") and submitting a corrected final inspection (DEQ Form 641-576A/S) by October 19, 2022. On April 12, 2021, DEQ personnel went to the above-described property and observed two separate residences, each with aerobic spray on-site sewage treatment systems installed on the property. On April 13, 2021, DEQ personnel issued you a compliance report (DEQ Form 641-003) identifying a failure to notify DEQ on the day construction of the systems began and a failure to submit final inspections within fifteen (15) days of installing the systems and requesting the correction of the violations by submitting complete and accurate final inspections by April 27, 2021. On April 30, 2021, DEQ personnel issued you a follow-up compliance report identifying the above-described violations and noting the final inspection had not been submitted. On April 21, 2021, DEQ personnel went to the above-described property and observed the on-site sewage treatment system was installed and in use. On May 3, 2021, DEQ personnel spoke to you regarding the above-described violation and made you aware that a compliance report would be issued. DEQ personnel were unable to locate a final inspection (DEQ Form 641-576A/S) for the above-described property. On April 21, 2021, DEQ personnel went to the above-described property and observed the on-site sewage treatment system was installed and in use. On May 3, 2021, DEQ personnel spoke to you regarding the above-described violation and made you aware that a compliance report would be issued. On May 3, 2021, DEQ personnel issued you a compliance report identifying a failure to notify DEQ on the day construction began and a failure to submit a final inspection within fifteen (15) days of installing the on-site sewage treatment system and requesting the correction of the violations by submitting the final inspection by May 20, 2021. On June 10, 2021, DEQ personnel issued you a follow-up compliance report identifying the above-described violations and noting the final inspection had not been submitted. Attached hereto as "Exhibit 10". Enforcement 177126 On August 22, 2022, DEQ personnel performed a records search for on-site sewage treatment system documents for property located at 1695 N 340 Rd, Haskell, Muskogee County, Oklahoma. DEQ personnel were unable to locate a soil test, an issued ATC, or final inspection (DEQ Form 641-576A/S) for the above-described property. On August 26, 2022, DEQ personnel went to the above-described property and observed an on-site sewage treatment system was installed and in use. DEQ personnel spoke to the property owner who stated that you had installed the on-site sewage treatment system. On August 29, 2022, DEQ personnel mailed and emailed you a compliance report identifying the above-described violations, noting that you also failed to notify DEQ on the day construction of the on-site sewage treatment system began, and requesting the correction of the violations by completing a final inspection by September 12, 2022. Attached hereto as "Exhibit 11". On September 13, 2022, DEQ personnel issued you a follow-up compliance report identifying the above-described violations and noting the final inspection had not been submitted. Attached hereto as "Exhibit 12". As of the date of this Notice of Violation ("NOV"), you have failed to submit final inspections for the above-described properties. ISSUE OAC 252:641-1-2.1(a) and (b) states in part: (a) Requirement for authorizations and permits. Before installing a new or modifying an existing on-site sewage treatment system, the installer shall first obtain either: (1) DEQ authorization to construct an on-site sewage treatment system under the general permit, the terms of which are the rules of this Chapter; or (2) an individual permit to construct an alternative on-site sewage treatment system. (b) Applying for authorizations; necessity for permit. (1) An installer seeking an authorization to construct a new or modify an existing on-site sewage treatment system shall submit a completed and signed: (A) DEQ Form 641-575, "Request for Authorization/Permit to Construct an On-Site Sewage Treatment System" along with the appropriate fee(s) [see 252:641-23 (relating to fees)] to DEQ's Oklahoma City office; (B) DEQ Form 641-581P or 641-581SP "Report for On-Site Sewage" to the local DEQ office. The detail needed varies with each system design; guidance will be provided by the local DEQ office; and (C) DEQ Form 641-581Cert "Certification Documentation Form" to the local DEQ office. DEQ alleges you are in violation of OAC 252-641-1-2.1 (a) and (b) for installing a system without a flow certification and a soil profile, and obtain an ATC for the on-site sewage treatment system you installed on property located at 1695 N 340 Rd, Haskell, Muskogee County, Oklahoma. OAC 252:641-21-12(a) states in part (a) Systems installed. For each new installation, modification or repair self-inspected and approved a certified installer shall comply with the following: (1) Notify DEQ. The installer must give DEQ an opportunity to inspect a portion of the system to ascertain that the certified installer continues to meet certification requirements. The certified installer shall notify the local DEQ office, before construction begins, of the time, date and location that an on-site sewage treatment system will be installed, modified or repaired. The installer shall pay DEQ a Fifty-Dollar ($50.00) fee each time the installer fails to notify the DEQ prior to commencing construction. (2) Submittals to DEQ. Within fifteen (15) working days after the work has been completed, the certified installer shall submit an accurate, completed DEQ Form 641-576A or 641-576S to the local DEQ office. The installer shall pay DEQ a Thirty Dollar ($30.00) fee each time the installer fails to submit a completed DEQ Form 641-576A or 641-576S within fifteen (15) days of completing the work. DEQ alleges you are in violation of 252:641-21-12(a) for failing to notify DEQ prior to installation and for failing to submit final inspections (DEQ form 641-576A/S) for the above-described properties except 1195 S Wichita Avenue Haskell, Muskogee County, Oklahoma. Department of Environmental Quality - Environmental Complaints and Local Services ("DEQ") of alleged non-compliance with statute(s), and/or rule(s). On July 17, 2023, DEQ personnel received a complaint regarding the unapproved installation of an on-site sewage treatment system on property located at 21925 E 104th St S, Broken Arrow, Wagoner County, Oklahoma, in the Charleston Estates subdivision. On July 17, 2023, DEQ personnel went to the above-described property and observed an on-site sewage treatment system had been installed. While at the property, DEQ personnel met with the property owner who stated that they believe you installed the on-site sewage treatment system and that there had been no one on the property to service the system. The property owner also stated that Mullins Plumbing had been contacted to perform maintenance on the on-site sewage treatment system and that, since having Mullins Plumbing perform maintenance, there had been no issues. The property owner's home was built by Cozort Homes. On July 30, 2023, DEQ personnel performed a records search of on-site sewage treatment system documentation for the above-described property but were unable to locate any. As such, the on-site sewage treatment system was installed without a flow certification and soil test, without obtaining an Authorization to Construct or Modify an On-site Sewage Treatment System ("ATC") from DEQ, and without requesting a DEQ final inspection. On September 19, 2023, DEQ personnel confirmed that you installed the majority of the on-site sewage treatment systems for Cozort Homes in the Charleston Estates subdivision. On October 9, 2023, DEQ personnel confirmed that you installed the on-site sewage treatment system on the above-described property. DEQ previously issued Notice of Violation ("NOV") Case No. 21-ECLS-NOV-067 to you on October 1, 2021, an Administrative Compliance Order ("ACO") Case No. 21-234 to you on January 31, 2022, NOV Case No. 22-ECLS-NOV-008 to you on April 13, 2022, NOV Case No. 22-ECLS-NOV-081 to you on December 23, 2022, and NOV Case No. 23-NOW-ECLS-012 on April 4, 2023, for similar violations noted herein. As of the date of this Notice of Violation ("NOV"), you have failed to submit a flow certification and soil profile, obtain an ATC, and request a DEQ final inspection for the above-described property. ISSUE OAC 252:641-1-2.1(a) and (b) states in part: (a) Requirement for authorizations and permits. Before installing a new or modifying an existing on-site sewage treatment system, the installer shall first obtain either: (1) DEQ authorization to construct an on-site sewage treatment system under the general permit, the terms of which are the rules of this Chapter; or (2) an individual permit to construct an alternative on-site sewage treatment system. (b) Applying for authorizations; necessity for permit. (1) An installer seeking an authorization to construct a new or modify an existing on-site sewage treatment system shall submit a completed and signed: (A) DEQ Form 641-575, "Request for Authorization/Permit to Construct an On-Site Sewage Treatment System" along with the appropriate fee(s) [see 252:641-23 (relating to fees)] to DEQ's Oklahoma City office; (B) DEQ Form 641-581P or 641-581SP "Report for On-Site Sewage" to the local DEQ office. The detail needed varies with each system design; guidance will be provided by the local DEQ office; and (C) DEQ Form 641-581Cert "Certification Documentation Form" to the local DEQ office. DEQ alleges you are in violation of OAC 252-641-1-2.1 (a) and (b) for failing to submit a flow certification and a soil profile, and obtain an ATC for the on-site sewage treatment system you installed on the above-described property. OAC 252:641-1-3(a) states: General requirements for on-site sewage treatment systems (a) Inspections. All new installations of modifications to and/or repairs to on-site sewage treatment systems shall be inspected and approved by the DEQ, or installed, self-inspected and approved by a certified installer before new installations, modifications or repairs can be backfilled and/or before the system may be placed into operation. The installer shall be responsible for requesting any required DEQ inspections. DEQ alleges you are in violation of OAC 252:641-1-2.1(a) for failing to request a DEQ final inspection for the on-site sewage treatment system you installed on the above-described property prior to backfilling the system. It is your duty to correct the violations referenced above within fifteen (15) days of your receipt of this Notice of Violation ("NOV"), by submitting a flow certification and soil profile, obtaining an ATC, and requesting a DEQ final inspection for the above-described property. RESPONDENT, ENFORCEMENT NUMBER ("NO.") 189505 CERTIFICATION NO. 593 CASE NO. 25 - 194 ADMINISTRATIVE COMPLIANCE ORDER This Administrative Compliance Order ("ACO") is issued by the State of Oklahoma, ex rel. Department of Environmental Quality ("DEQ") pursuant to the authority vested in the Executive Director by 27A O.S. § 2-3-502. This ACO relates to violations of the Oklahoma Environmental Quality Code, specifically 27A O.S. § 2-6-101 et seq., and Oklahoma Administrative Code ("OAC") Title 252 Chapter 641, Individual and Small Public On-Site Sewage Treatment Systems. This ACO supersedes and closes Notice of Violation ("NOV") Case No. 25-ECLS-NOV-010 issued by DEQ on April 24, 2025. Attached hereto as "Exhibit A". FINDINGS OF FACT 1. Respondent is an inactive, formerly certified installer (License No. 593) of on-site sewage treatment systems in the State of Oklahoma. Respondent, Yocham Backhoe Works, Inc., is inactive and no longer a Domestic Limited Liability Company registered with the Oklahoma Secretary of State. Donnie Yocham is the registered agent of Yocham Backhoe Works. Respondent, Donnie Yocham, is responsible for installing the on-site sewage treatment system noted herein and operates under the name Yocham Backhoe Works. 2. On January 31, 2025, DEQ personnel performed a spot check on an installation of an on-site sewage treatment system on property located at 2131 E. 90th St. N., Wagoner, Wagoner County, Oklahoma. They observed an aerobic-spray treatment system had been installed and placed into service. 3. On January 31, 2025, DEQ personnel determined that DEQ had issued an Authorization to Construct or Modify an On-Site Sewage Treatment System ("ATC") to Respondent for the above-described property on December 29, 2022, but that a final inspection had not been completed. 4. On February 20, 2025, DEQ personnel issued a compliance report to Respondent identifying that the on-site sewage treatment system was missing adequate risers and a final inspection had not been submitted. "Attached hereto as 'Exhibit 1 of A.'" 5. Also on February 20, 2025, DEQ personnel contacted Respondent on the phone and discussed the compliance report. 6. On April 24, 2025, DEQ issued NOV Case No. 25-ECLS-NOV-010 to Respondent. Respondent received the NOV on May 7, 2025, as evidenced by the United States Postal Service ("USPS") tracking notification. The NOV required that the documented violations be corrected and a final inspection for the property be requested. Attached hereto as "Exhibit B." 7. On June 20, 2025, DEQ personnel contacted Respondent and discussed the NOV by phone. 8. As of the date of this ACO, Respondent has failed to correct the system violations and request a final inspection from DEQ prior to backfilling and placing the system into operation. CONCLUSIONS OF LAW 9. DEQ has regulatory jurisdiction and authority in this matter, and Respondent is subject to the jurisdiction and authority of DEQ under 27A O.S. § 1-3-101(B) and 2-6-101, et. seq. and OAC 252:641. 10. OAC 252:641-1-3(a) states: (a) Inspections. All new installations of, modifications to and/or repairs to on-site sewage treatment systems shall be inspected and approved by the DEQ, or installed, self-inspected and approved by a certified installer before new installations, modifications or repairs can be back filled and/or before the system may be placed into operation. The installer shall be responsible for requesting any required DEQ inspections. DEQ alleges you are in violation of OAC 252-641-1-3(a) for failing to seek a final inspection prior to backfilling and operation for the on-site sewage treatment system Respondent installed on the above-described property. ORDER 11. Based on the above paragraphs, the Executive Director orders as follows: a. Respondent shall, within thirty (30) days of receipt of this ACO, correct any deficiencies documented for the on-site sewage system listed above. b. Respondent shall, within thirty (30) days of receipt of this ACO, request a final inspection for the on-site sewage system listed above. c. Respondent shall remain in compliance with all DEQ and OAC rules and regulations. 12. The Oklahoma Environmental Quality Code, 27A O.S. § 2-3-502(B) and (K) authorizes DEQ to seek penalties of up to TEN THOUSAND DOLLARS ($10,000.00) per day for each violation of the associated rules. Based on the facts and circumstances of this case, DEQ assesses a total penalty of TEN THOUSAND FIVE HUNDRED DOLLARS ($10,500.00) (invoice enclosed). Respondent shall submit payment for the penalty within thirty (30) days of receipt of this ACO. Payment shall be by check or money order payable to the Oklahoma Department of Environmental Quality (or DEQ), showing the Case Number of this ACO, and delivered to: Accounts Receivable Financial & Human Resources Management Department of Environmental Quality P.O. Box 2036 Oklahoma City, OK 73101-2036 13. If Respondent has any further violations after the execution of this ACO, he may be subject to additional penalties and escalated enforcement. 14. If Respondent fails to pay any penalty, DEQ may bring a separate action for collection of the penalty in district court. Any action by DEQ for the collection of a penalty does not affect Respondent’s duty to complete the tasks required by this ACO. GENERAL PROVISIONS 15. Respondent shall allow agents of DEQ entry onto the property, at reasonable times and without advance notice, for the purposes of inspecting, sampling, testing, records review, and other authorized activities to assess compliance with Oklahoma statutes and rules and this ACO. 16. This ACO is in addition to any other remedies provided by law and does not preclude DEQ from seeking other relief as appropriate. NOTICE OF OPPORTUNITY TO REQUEST HEARING 17. This ACO is entered under the authority of 27A O.S. § 2-3-502. This ACO will automatically become final unless, no later than fifteen (15) days after it is served, Respondent submits to DEQ a written request to review this ACO. The scope of the hearing will be limited to the matters raised in the request for hearing, unless otherwise permitted by the Administrative Law Judge for good cause. The hearing will be conducted in accordance with the Oklahoma Administrative Procedures Act. The Administrative Law Judge may schedule pre-hearing conferences as deemed necessary. 19. Respondent may be present and/or represented by an attorney at the hearing. Respondent or counsel may present evidence and argument to show why this ACO should be set aside, or modified. 20. On the basis of the hearing record, the Executive Director of DEQ will sustain, set aside, or modify the ACO. NOTICE OF OPPORTUNITY TO DISCUSS SETTLEMENT 21. Regardless of whether Respondent requests a hearing, they may confer with the Environmental Complaints and Local Services Division regarding a settlement. A settlement conference may be pursued simultaneously with, or as an alternative to, the hearing process, but a request for a settlement conference does not extend the fifteen (15) day period to request a hearing. Respondent may be present and/or represented by an attorney at a settlement conference. 22. Any settlement reached by the parties shall be finalized in the form of a written Consent Order ("CO") signed by Respondent and the DEQ Executive Director. The issuance of a CO waives Respondent's right to pursue a hearing on any issue covered by the CO. 23. The contractor informed DEQ personnel that an add-on was planned for the on-site sewage treatment system. DEQ personnel observed an aerobic-spray on-site sewage treatment system had been installed and placed into service. On January 31, 2025, DEQ personnel performed a record search for the above-described property and discovered an Authorization to Construct or Modify an On-Site Sewage Treatment System ("ATC") issued to you on December 29, 2022. During the records search DEQ personnel also determined that a final inspection had not been completed for the property. On February 3, 2025, DEQ personnel spoke with Scott Spendlove, owner of the above-described property, who stated that he was not provided with the final inspection, but someone had come to the property to adjust the on-site sewage treatment system. DEQ personnel confirmed that the property owner moved in January of 2023. On February 20, 2025, DEQ personnel sent you a compliance report (DEQ Form 641-003) identifying the above-described violations and requesting the correction of the violations by completing a final inspection immediately. *Attached hereto as "Exhibit 1".
