American Express National Bank v. Lowell Adams

Filed: Mar 23, 2026
Type: CJ

What's This Case About?

Let’s be real: nobody tunes into a civil debt collection case expecting drama. But when a man owes American Express $36,663.46—on a credit card that’s been maxed out, past due, and still racking up interest like it’s vacationing in the Maldives—you know you’re not just dealing with a forgotten $20 late fee. This isn’t a “forgot to cancel a subscription” situation. This is a full-blown financial slow-motion car crash, and we’re all rubbernecking as it careens into the legal ditch.

Meet Lowell Adams—also known, for reasons unknown and possibly dramatic, as Todd Adams. He lives in Bixby, Oklahoma, a quiet suburb of Tulsa where the biggest scandal is usually someone mowing their lawn on a Sunday. Lowell—or Todd, or whoever’s name is on the mailbox—once held a Delta SkyMiles® Gold Card from American Express. Not the platinum, not the black, but still: this is not a store credit card from JCPenney. This is the kind of card that says, “I fly business when I can, I know the lounge code, and yes, I do collect airline miles.” At least, he used to. Now? He’s the guy American Express is suing in Tulsa County District Court because he hasn’t paid his bill since January 19, 2025. That’s over a year ago. And in that time, his debt didn’t disappear. It festered. Like a financial mold colony growing in the dark corners of unchecked statements and ignored payment coupons.

The story, as told by a dry legal petition and a haunting final credit card statement, goes like this: Lowell opened the account. He spent. A lot. By November 14, 2021—yes, four years ago—he already had a balance of $35,707.63 on purchases. That’s not a vacation. That’s not even a new car. That’s a down payment on a house in some parts of Oklahoma. And instead of paying it down, he kept using the card, or at least let the interest do the spending for him. The account had a credit limit of $35,000. He blew past it. By May 2025, his balance was $36,663.46. Over limit. In default. And still accruing interest at a whopping 28.99% variable APR. That’s not a credit card rate. That’s a loan shark with a business license.

The last statement—Exhibit 1, the pièce de résistance of financial despair—shows a balance of $36,663.46. The minimum payment? $6,526.89. Let that sink in. The minimum to stay current was over six and a half grand. For context, the median monthly rent in Bixby is around $1,400. This minimum payment could cover five rents. And it wasn’t even enough to stop the bleeding—the statement helpfully informs Todd (or Lowell?) that if he only paid the minimum every month, it would take 32 years to pay off the balance… and he’d end up shelling out a grand total of $111,567 in interest and fees. That’s more than the average price of a home in Tulsa. All for whatever it was he bought back in 2021.

But here’s the kicker: the statement is dated May 25, 2025. The payment was due June 19, 2025. He didn’t pay. And then—nothing. No payments. No calls. No attempts to set up a payment plan, no bankruptcy filing, no dramatic letter explaining that he’d been abducted by pirates or finally joined a monastery. Radio silence. So on January 27, 2026, American Express, through their debt collection attorneys Nelson and Kennard, LLP (a firm that sounds like a 19th-century law partnership from a Dickens novel), filed a lawsuit. The claim? Breach of contract. Simple as that. You signed up. You agreed to pay. You didn’t. Now we want our money.

And how much do they want? $36,663.46. Plus fees. Plus court costs. Plus attorney’s fees, though those aren’t itemized. Is that a lot? Well, for a credit card debt, yes and no. It’s not a million-dollar fraud case. But for an individual in Oklahoma, that’s serious money. It’s two brand-new Toyota Camrys. It’s a year’s salary for someone making minimum wage. It’s enough to bankrupt a family, and judging by the lack of legal representation listed for Lowell, it might have already done just that. There’s no indication he’s fighting this. No counterclaim. No “I was hospitalized” or “I never opened this account.” Just… silence.

So why are we here? Why does this matter? Because this isn’t just about one guy and his credit card. This is a window into the machine. American Express didn’t come knocking with torches and pitchforks. They sent a PDF to a clerk in Tulsa County. They attached a statement. They cited a breach. And they’re letting the courts do the dirty work. This is how debt collection works in America: quiet, bureaucratic, and utterly relentless. No drama. No yelling. Just a number on a page, growing like a tumor, until someone sues.

And the most absurd part? The miles. Look at that statement again. “Miles Earned for Eligible Purchases: 0.” Zero. In the entire billing period. He earned no miles on $36,000 of debt. Not one Delta SkyMiles. After racking up nearly 3,000 miles over the years, the final statement shows nothing. No rewards. No perks. Just fees, interest, and a balance that would make a hedge fund manager blink. He didn’t even get the free flight to Atlanta. He got nothing. Not even a complimentary cocktail.

So where do we stand? American Express wants their money. Lowell Adams—aka Todd Adams, aka the man who may or may not know his own legal name—owes it. The court will likely agree. Judgment will probably be entered. Then what? Wage garnishment? Bank levy? Or will Lowell vanish into the ether, leaving AmEx to write off the debt and sell it to a collection agency with a name like “Vulture Financial Partners LLC”?

We’re rooting for closure. Not for the bank, not for the debtor, but for the sheer absurdity of a system that lets a credit card balance grow to $36,000, charges a $40 late fee like it matters, and then sends a polite letter asking you to update your contact info—while suing you for bankruptcy-level debt. This isn’t just a breach of contract. It’s a breach of common sense. And if Lowell Adams ever does book that free flight, we hope he upgrades to first class. He’s earned it. In miles, if not in life.

(We’re entertainers, not lawyers. This is based on public filings. No actual sky miles were harmed in the making of this article.)

The method we use to figure the ADB and interest results in daily compounding of interest. Paying Interest: Your due date is at least 25 days after the close of each billing period. We will not charge you interest on your purchases if you pay each month your entire balance (or Adjusted Balance if applicable) by the due date each month. We will charge you interest on cash advances and (unless otherwise disclosed) balance transfers beginning on the transaction date. Foreign Currency Charges: If you make a Charge in a foreign currency, we will convert it into US dollars on the date we or our agents process it. We will choose a conversion rate that is acceptable to us for that date, unless a particular rate is required by law. The conversion rate we use is no more than the highest official rate published by a government agency or the highest interbank rate we identify from customary banking sources on the conversion date or the prior business day. This rate may differ from rates in effect on the date of your charge. Charges converted by establishments (such as airlines) will be billed at the rates such establishments use. Credit Balance: A credit balance (designated CR) shown on this statement represents money owed to you. If within the six-month period following the date of the first statement indicating the credit balance you do not request a refund or charge enough to use up the credit balance, we will send you a check for the credit balance within 30 days if the amount is $1.00 or more.
