On one side, we’ve got Flora Gonzales—presumably a real person living in a small Oklahoma town where the nearest Starbucks is probably a 90-minute drive. She opened a Fingerhut Fetti credit account back in April 2022, likely to buy stuff like kitchen gadgets, seasonal decor, or maybe a new comforter—all the things that make life feel a little cozier when you’re miles from anywhere. Fingerhut Fetti, for the uninitiated, is the financial arm of that mail-order catalog you remember from the back of old magazines. It’s credit for people who might not qualify for a Chase Sapphire card, often with APRs so high they could launch a small satellite into orbit. In Flora’s case, her interest rate was a cool 35.99%. That’s not a typo. If you carry a balance, you’re paying over a third of it every year in interest. That’s loan shark territory, but with better branding.

On the other side? LVNV Funding LLC. Sounds like a real company, right? Feels like a real company. But LVNV isn’t some mom-and-pop debt shop in a strip mall. It’s a debt buyer—a financial vampire that scours the remains of failed credit accounts, scooping up thousands of delinquent balances for pennies on the dollar, then sues to collect the full amount. And they don’t work alone. The paper trail here is like a Russian nesting doll of corporate ghosting. Flora’s debt started with WebBank, which issued the Fingerhut Fetti card. Then WebBank sold a whole batch of defaulted accounts—including Flora’s—to a company called BLST Sales, Marketing & Servicing, LLC. BLST then flipped it to Resurgent Acquisitions, LLC, which finally sold it to LVNV Funding. All of this happened in late September 2024, in a transaction so impersonal it was sealed with digital file names and line numbers. Flora’s identity? Just “LineNumber: 14614” in a spreadsheet. Her humanity? Not included in the sale.

So what actually happened? According to the court filing, Flora opened the account, made some purchases, and stopped paying. Her last payment was on January 1, 2024—$59.99, a symbolic gesture, maybe, or just enough to keep the account from immediate collapse. By June 2024, her balance had ballooned to $1,127.36, mostly from interest piling up like snow on a neglected sidewalk. The final statement, Exhibit 1, is a masterpiece of financial dread: a minimum payment of $429.93 due by July 13, 2024, with a warning that if she only pays the minimum from now on, she’ll end up shelling out $1,448 over three years. That’s the trap: pay a little now, bleed a lot later. She didn’t pay. The account was “charged off” on July 15, 2024—meaning the original lender gave up and wrote it off as a loss. But that’s not the end. That’s when the debt got interesting. It was packaged, sold, and weaponized.

Now, LVNV is in Kiowa County District Court, asking a judge to order Flora to pay the full $1,127.36—plus court costs, sheriff’s fees, and attorney fees, because of course they want more. Their legal claim? “Breach of contract.” In plain English: Flora agreed to pay, she didn’t, so now they want the money. It’s the most basic debt collection case in the book. But the absurdity isn’t in the claim—it’s in the chain of custody. LVNV must prove they actually own this debt. And their proof? A series of PDFs and spreadsheets showing that yes, somewhere in a server farm in Minnesota, Flora Gonzales was one of 1,000 names in a file called “SHER_Fetti_BLST_092024.” It’s like proving you own a haunted house by showing a receipt from a ghost auction.

And let’s talk about that $1,127.36. Is it a lot? In the grand scheme of civil lawsuits, it’s chump change. A fancy lawyer might bill that in half a day. But for someone in rural Oklahoma, where the median household income is around $50,000, over a grand is real money. It’s a car repair. It’s two months of groceries. It’s a security deposit on a new apartment. And yet, LVNV—and the law firm Nelson and Kennard, LLP, representing them from Colorado—think it’s worth suing over. HOW WE CALCULATE INTEREST CHARGES To calculate the interest charge payable each month, we multiply the average daily balance times the monthly periodic rate. Your monthly periodic rate may vary each billing cycle. The monthly periodic rate is determined by dividing the APR by 12. Your Account is subject to a minimum interest charge of $1.00. Average Daily Balance. We figure the interest charge on your Account by applying the monthly periodic rate to the "average daily balance" of your Account, including current transactions. To get the "average daily balance" we take the beginning balance of your Account each day, add any new purchases, charges and other fees, and subtract any payments or credits.
